9.0 EIR Subject Areas Requiring No Change in Analysis <br />Avion Project SEIR <br />Page 9-7 <br />significant for the subject site. Because the project is consistent with the land use and buildout <br />assumptions and conceptual development footprint identified in the Subarea Plan, noise impacts <br />associated project traffic and noise contours associated with surrounding roadways would be <br />consistent with the analysis in the 1998 EIR. The project would not result in any new significant or <br />substantially increased adverse impacts beyond those previously identified in the EIR relative to <br />operational noise. <br />The 1998 EIR indicated that potential future construction-related noise impacts to sensitive wildlife <br />within the Multi-Habitat Preservation Area (MHPA) may result from grading and construction in the <br />southeast perimeter properties. MHPA adjacency impacts associated with noise are addressed in <br />Section 5.1.5 of this SEIR. Additionally, blasting may be required during construction activities. <br />Construction noise and vibration impacts require subsequent analysis and are addressed in <br />Section 5.6.4 of this SEIR. <br />9.10 Public Facilities and Services <br />As required of all development proposals, the project would be required to pay applicable impact <br />fees for public facilities and services prior to the issuance of building permits. <br />9.10.1 Schools <br />The 1998 EIR concluded that the additional elementary, middle, and high school students generated <br />by buildout of the Subarea Plan would contribute to the already overcrowded schools and is <br />considered a direct and cumulatively significant impact. The 1998 EIR stated that implementation of <br />the following condition and offers of dedication would reduce direct and cumulative school impacts <br />from subarea development to below a level of significance: <br />a) Collection of required fees and setting aside three school sites, and provision of partial acreage <br />for a future high school site. <br />Mitigation for school impacts would include implementation of a final financing agreement and <br />phasing plan for future development in the subarea and the Poway Unified School District as <br />identified in the school district’s School Facilities Master Plan and Financing Plan for the Black <br />Mountain Ranch Subarea, which may or may not include participation in school facilities financing <br />with other surrounding development projects. The Poway Unified School District proposed <br />establishment of a Mello-Roos community facilities district; however, some other mutually <br />acceptable means could be employed. Proof of a final financing agreement and school site purchase <br />agreement would be required prior to City Council approval of the Subarea Plan. <br />School impacts would be reduced to below a level of significance by implementing the mitigation <br />measures identified in the 1998 EIR. Because the project is consistent with the land use and buildout <br />assumptions and conceptual development footprint identified in the Subarea Plan, impacts to <br />schools would be consistent with those previously identified, and the project would not result in any <br />new significant or substantially increased adverse impacts beyond those previously identified in the <br />EIR.
