iacu:1r6 <br />FIRST AMENDMENT TO AGREEMENT TO PROVIDE CITY-WIDE <br />FIBER OPTIC BROADBAND NETWORK CONSULTING SERVICES <br />THIS FIRST AMENDMENT to the above -referenced agreement is entered into on November 17, <br />2020, by and between Magellan Advisors LLC ("Consultant"), and the City of Santa Ana, a charter <br />city and municipal corporation organized and existing under the Constitution and laws of the State <br />of California ("City"). <br />RECITALS <br />A. The parties entered into Agreement No. A-2018-096, dated April 3, 2018, by which <br />Consultant agreed to provide City -Wide Fiber Optic Broadband Network Consulting <br />Services ("Agreement"). <br />B. The Agreement remains in effect through April 2, 2021, with provision for extension. <br />C. The parties now wish to expand the scope of work and increase the amount to be <br />expended under the Agreement in consideration of the expanded scope. <br />The Parties therefore agree: <br />1. Section 1, Scope of Services, is amended to include the scope of services described on Exhibit <br />A. <br />2. Section 2.a., Compensation, is amended to increase the total sum to be expended under the <br />term of the Agreement by $36,685, which is comprised of (1) the base sum of $33,350 as the <br />base amount plus (2) a contingency in the amount of $3,335 for additional services at the City's <br />sole discretion. <br />3.
