4.6.2 Maintenance Restrictions. The Restrictions require that Agent shall have <br />the right to require, and that Tenants shall be obligated to pay to Agent monthly payments <br />established by Agent sufficient to fund a maintenance reserve for the ongoing maintenance of <br />capital improvements required to preserve the home, including the roof, landscape and painting of <br />the home, which funds Agent shall apply for those purposes as may become necessary, in Agent's <br />reasonable discretion. <br />ARTICLE V <br />CONSTRUCTION OF IMPROVEMENTS <br />5.1 Construction of Improvements. <br />5.1.1. Initial Improvements. Developer shall be governed by the provisions of the <br />Inclusionary Grant Agreement entered into concurrently with this Lease with respect to <br />construction of the Initial Improvements. <br />5.1.2. Compliance with Laws and Permits. Tenant shall cause all Improvements <br />made by Tenant after the Initial Improvements to be constructed in substantial compliance with all <br />applicable Laws, including all applicable grading permits, building permits, and other permits and <br />approvals issued by governmental agencies and bodies having jurisdiction over the construction <br />thereof. <br />5.2 Ownership of Improvements. <br />5.2.1. For purposes of this Section 5.5, "Term" shall have the meaning stated in <br />Section 2.2. <br />5.2.2. During Term. Title to the Improvements constructed or placed on the <br />Premises by Developer are and shall be vested in Developer during the Term of this Lease, until <br />the expiration or earlier termination thereof. Any and all depreciation, amortization and tax credits <br />for federal or state purposes relating to the Improvements located on the Premises and any and all <br />additions thereto shall be deducted or credited exclusively by Developer during the Term. The <br />Parties agree for themselves and all persons claiming under them that the Improvements are real <br />property. <br />5.2.3. Upon Expiration or Earlier Termination of Term. All Improvements on <br />the Premises at the expiration or earlier termination of the Term of this Lease shall, without <br />additional payment to Tenant, then become Lessor's property free and clear of all claims to or <br />against them by Tenant and free and clear of all Leasehold Mortgages and any other liens and <br />claims arising from Tenant's use and occupancy of the Premises, and with Taxes paid current as <br />of the expiration or earlier termination date.
