• Compliance with the City's affirmative marketing requirements and procedures will be made an <br />obligation of all rental property owners receiving HOME or CDBG assistance from the City of <br />Santa Ana, and will be enforceable by means of appropriate actions described in loan <br />documents recorded through the County of Orange. <br />Record keeping: <br />• The City will require owners of its HOME- and CDBG- assisted rental units covered under this <br />marketing plan to make an annual report to the City detailing the steps they have taken to <br />comply with this Program. They will also be required to report on the ethnicity of their tenants, <br />as well as rents, income levels, and other household characteristics. Reports will be made on a <br />form that is acceptable to the City of Santa Ana, and that will enable the City to capture the data <br />it needs to evaluate owner compliance with this Program. <br />• The City will maintain records on owner reports and its evaluation of those reports for a period <br />of not less than ten years after expiration of the affordability period required by applicable HUD <br />regulations. <br />Annual assessment: <br />• Upon receipt of owner reports, the City will evaluate the ethnic and racial characteristics of <br />tenants being served to determine if they reflect the City's housing market.
