DA CORTE and LANNIE ANN DA CORTE, husband �and <br />wife, hereinafter referred to as "Grantors" and the CITY OF SANTA <br />ANA, a municipal corporation of the State of California, <br />hereinafter referred to as "Grantee" <br />A. Grantors are the owners of certain real property situated <br />in the City of Santa Ana, Orange County, California, (hereinafter <br />referred to as the "Servient Tenement" and more particularly <br />described as follows: <br />LOT 44 OF TRACT NO. 6036 AS SHOWN ON A <br />MAP RECORDED IN BOOK 221, PAGES 9, 10 <br />AND 11, INCLUSIVE, OF MISCELLANEOUS <br />MAPS, IN THE OFFICE OF THE COUNTY <br />RECORDER OF ORANGE COUNTY, CALIFORNIA <br />B. Grantee desires to acquire certain rights in the Servient <br />Tenement. <br />the parties do hereby agree as follows: <br />1. Grantor grants to Grantee an easement, subject to the <br />terms of this Agreement. <br />2. The easement granted in this Agreement is in gross. <br />3. The easement granted in this Agreement is the right to <br />install and maintain a sign on the existing block wall located on <br />the west side of Spruce Street between Segerstrom Avenue and <br />Carriage Drive, which sign shall identify the Servient Tenement as <br />"Republic Homes" and shall contain an eagle logo. <br />4. The easement granted in this Agreement includes the right <br />of access to the Servient Tenement as reasonably necessary to <br />install and maintain the subject sign. In exercising these right, <br />Grantee must use reasonable care and may not unreasonably increase <br />the burden on the Servient Tenement or make any material changes to <br />the Servient Tenement other than the subject sign. <br />5. Grantee shall hold harmless, indemnify and defend Grantor <br />1 <br />
