Ls 10.12.20 <br />RESOLUTION NO. 2020-34 <br />A RESOLUTION OF THE PLANNING COMMISSION OF <br />THE CITY OF SANTA ANA APPROVING SITE PLAN <br />REVIEW NO. 2020-03 AS CONDITIONED FOR A NEW <br />MIXED -USE RESIDENTIAL AND COMMERCIAL <br />DEVELOPMENT FOR THE PROPERTIES LOCATED AT <br />409 EAST FOURTH STREET (SITE A) AND 509 EAST <br />FOURTH STREET (SITE B) <br />BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF <br />SANTA ANA AS FOLLOWS: <br />Section 1. The Planning Commission of the City of Santa Ana hereby finds, <br />determines and declares as follows: <br />A. Andrew Nelson, with Red Oak Investments, LLC, representing Northgate <br />Gonzalez Real Estate (hereinafter referred to as "Applicant"), is seeking <br />approval of various entitlements including Site Plan Review No. 2020-03, <br />Variance No. 2020-06, and Amendment Application 2020-04 to allow the <br />construction of a new mixed -use residential and commercial development <br />consisting of 169 residential rental units and 11,361 square feet of <br />commercial space at 409 and 509 East Fourth Street; and <br />B. The Applicant has requested approval of Site Plan Review No. 2020-03 as <br />conditioned, to allow the construction of structures over four stories in <br />height as part of the new mixed -use residential and commercial <br />development at 409 and 509 East Fourth Street; and <br />C. The Transit Zoning Code was adopted in 2010 as a result of interest in <br />developing mixed -use residential and commercial projects in its project <br />area. The Transit Zoning Code was amended in 2019 to modernize and <br />refine development standards to further these interests. The regulating <br />plan, which establishes land uses and development standards, allows a <br />variety of housing and commercial projects, including mixed -use <br />residential communities, live/work units, hotels, and offices. <br />D. On October 12, 2020, the Planning Commission of the City of Santa Ana <br />held a duly noticed public hearing regarding Site Plan Review No. 2020-03 <br />and at that time considered all testimony, written and oral. <br />E. Sections 41-2007 and 41-593.5 of the Santa Ana Municipal Code (SAMC) <br />requires a review by the Planning Commission of all plans for <br />developments of over four stories within the Transit Zoning Code (Specific <br />Development No. 84) to ensure the project is in conformity with the <br />overlay zone plan. <br />
