<br />First Party Glossary of Defined Terms
<br />C. any natural person leased to the Named Insured, under an agreement between the Named Insured and a labor
<br />leasing firm, while that person is subject to the Named Insured's direction and control and performing services
<br />for the Named Insured;
<br />D. any non -compensated natural person:
<br />1. other than one who is a fund solicitor, while performing services for the Named Insured that are usual to the
<br />duties of an employee or officer; or
<br />2. while acting as a fund solicitor during fund raising campaigns; or
<br />E. solely with respect to an employee benefit plan, any natural person who is required to be bonded by the
<br />Employee Retirement Income Security Act of 1974 (ERISA), any amendments thereto and any regulations
<br />promulgated thereunder.
<br />Other than with respect to an employee benefit plan, employee does not include any:
<br />1. agent, broker, factor, commission merchant, consignee, independent contractor or representative of the same
<br />general character; or
<br />2. manager, member, partner, proprietor, director or trustee, but solely to the extent he or she is acting in his or her
<br />capacity as such.
<br />Employee Benefit Plan
<br />Employee benefit plan means an employee welfare benefit plan or an employee pension benefit plan as more fully
<br />set forth in Title 1, Section 3 of the Employee Retirement Income Security Act of 1974 (ERISA) and any amendments
<br />thereto and which is solely sponsored by the Named Insured.
<br />Employee Theft
<br />Employee theft means theft committed by an employee to the deprivation of the Named Insured or an employee
<br />benefit plan, whether identified or not, acting alone or in collusion with others. Solely with respect to an employee
<br />benefit plan, employee theft means all acts of fraud or dishonesty required to be bonded against by the Employee
<br />Retirement Income Security Act of 1974 (ERISA), any amendments thereto and any regulations promulgated
<br />thereunder.
<br />Employee theft also includes forgery of such property by an employee.
<br />Equipment Breakdown Peril
<br />Equipment breakdown peril means:
<br />A. Artificially generated electrical current, including electrical arcing, that injures or disturbs electrical devices wiring
<br />or equipment.
<br />B. Explosion, rupture or bursting of steam boilers, steam pipes, steam engines, stream turbines, gas turbines or
<br />apparatus attached to and forming a part thereof, when owned, operated or controlled by the Named Insured,
<br />except for the explosion of accumulated gases or fuel within the furnace of any fired vessel, other than gas
<br />turbines, or within the flues or passages through which the products of combustion pass.
<br />C. Any condition or event inside steam boilers, steam pipes, steam engines, steam turbines, gas turbines or
<br />apparatus attached to and forming a part thereof, when owned, operated or controlled by the Named Insured;
<br />except for explosion of accumulated gases or fuel within the furnace of any fired vessel, other than gas turbines,
<br />or within the flues or passages through which the gases of combustion pass.
<br />D. Any condition or event, other than an explosion, inside hot water boilers, other water heating equipment, engines
<br />other than steam engines or pressure vessels when owned, operated or controlled by the Named Insured.
<br />E. Mechanical or machinery breakdown, including rupture or bursting caused by centrifug
<br />operated or controlled by the Named Insured.
