CNA CNA PARAMOUNT <br />First Party Terms and Conditions <br />The Insurer will not be held to have waived any of its rights by any act relating to an appraisal. If there is an appraisal, <br />the Insurer will still retain its right to deny the claim or challenge whether the damages from any loss are covered or <br />otherwise excluded. <br />The Named Insured may only make a written demand for appraisal if the Named Insured has fully complied with all <br />provisions of this Policy. <br />III. COMPLIANCE <br />No one may make a claim under the Business Property Coverage Part unless: <br />A. there has been full compliance with all of the provisions of the Business Property Coverage Part; and <br />B. the claim for coverage is brought within 2 years and 1 day after the date on which the direct physical loss or <br />damage occurred. <br />IV. CONCEALMENT, MISREPRESENTATION AND FRAUD <br />This entire Policy shall be void if, whether before or after a loss, the Named Insured or designated representative: <br />A. has concealed or misrepresented any material fact or circumstance concerning: <br />1. this insurance or the subject thereof; <br />2. the interest of the Named Insured therein; or <br />3. any claim; or <br />B. has falsely sworn to any such material fact or circumstance. <br />V. CONTROL OF PROPERTY <br />Any act or neglect by any person, other than a Named Insured designated representative, of any provision of these <br />conditions or the Business Property Coverage Part, will not affect coverage. Breach of any condition of coverage at <br />one or more locations or reported unspecified locations will not affect coverage at any other building where, at the <br />time of loss or damage, the breach of condition did not exist. <br />VI. DUTIES AFTER LOSS OR DAMAGE <br />In the event of loss or damage, the Named Insured shall do the following: <br />A. Take all necessary steps to protect the property from further loss or damage. <br />B. Set aside the damaged insured property for examination by the Insurer as often as may be required and keep a <br />record of its expenses necessary to protect insured property. <br />C. As soon as practical, give written notice to the Insurer, or its designated representative, of the event giving rise to <br />the loss or damage, including the date and time of such event, what occurred and the names and addresses of <br />witnesses. <br />D. Within 60 days after being requested by the Insurer, render to the Insurer a detailed, sworn proof of loss on a form <br />provided by the Insurer; <br />E. As often as may be reasonably required, exhibit to any person designated by the Insurer all that remains of any <br />damaged or undamaged property and permit the Insurer to take samples of such property for inspection and <br />analysis. <br />F.
