CNA CNA PARAMOUNT <br />Employee Benefits Liability Coverage Part - Occurrence <br />Advertisement means a notice that is broadcast or published to the general public or specific market segments about <br />the Named Insured's goods, products or services for the purpose of attracting customers or supporters. For the <br />purposes of this definition: <br />A. notices that are published include material placed on the Internet or on similar electronic means of <br />communication; and <br />B. regarding web -sites, only that part of a web -site that is about the Named Insured's goods, products or services <br />for the purposes of attracting customers or supporters is considered an advertisement. <br />Authorized Insured means any executive officer, member of the Named Insured's human resources, risk <br />management or in-house general counsel's office, or any employee authorized by the Named Insured to give or <br />receive notice of a claim. <br />Bodily injury means physical injury, sickness or disease sustained by a person, including death, humiliation, shock, <br />mental anguish or mental injury by that person at any time which results as a consequence of the bodily injury, <br />sickness or disease. <br />Cafeteria plans means plans authorized by applicable law to allow employees to elect to pay for certain benefits with <br />pre-tax dollars. <br />Claim means: <br />A. suit; or <br />B. a written or oral demand for damages <br />alleging negligent acts, errors or omissions committed in the administration of the Named Insured's employee <br />benefit plans. <br />Circumstance means an act, error or omission reported during the policy period from which an executive officer <br />reasonably expects that a claim could be made. <br />Coverage part means only those coverage parts designated as included in the Schedule of Forms and <br />Endorsements. <br />Coverage territory means: <br />A. the United States of America (including its territories and possessions), Puerto Rico and Canada; <br />N <br />B. international waters or airspace, but only if the injury or damage occurs in the course of travel or transportation <br />N <br />s between any places included in Paragraph A. above. <br />N <br />Damages means the amount an Insured is legally obligated to pay, either through: <br />N <br />O <br />A. final adjudication of a covered claim; or <br />B. through compromise or settlement of a covered claim with the Insurer's written consent or direction. <br />In addition, damages includes the above mentioned sums only after deducting all other recoveries and salvages. <br />However, damages does not include with respect to any claim; <br />1. restitution, return or disgorgement of fees, costs and expenses paid or incurred or charged by an Insured, no <br />matter whether claimed as restitution of specific funds, forfeiture, financial loss, set-off or otherwise, and <br />injuries that are a consequence of any of the foregoing; <br />2. civil or criminal fines, sanctions, penalties forfeitures, or taxes whether pursuant to statute, regulation or <br />court rule, including those imposed under the Internal Revenue Code; <br />3. the multiplied portion of multiplied awards imposed pursuant to any statute or regulation requiring such <br />awards; <br />4. injunctive or declaratory relief; <br />CNA74721XX 01-15 <br />Copyright CNA All Rights Reserved. <br />�ortaN <br />of <br />RiskMmRgemerttDivisfan <br />REVIEWED & APPROVED BY.- <br />c 1, AA� �.e <br />F�s.r,;.s.e PZ.
