DNA <br />CNA Paramount Excess and Umbrella Liability <br />Policy <br />9. Recall of Products, Work or Impaired Property <br />any actual or alleged loss, cost or expense incurred by the Named Insured or any person or entity, <br />for the loss of use, withdrawal, recall, inspection, repair, replacement, adjustment, removal or <br />disposal of your product, your work or impaired property, if such product, work, or property is <br />withdrawn or recalled from the market or from use by any person or organization because of a <br />known or suspected defect, deficiency, inadequacy or dangerous condition in it. <br />10. Unfair Competition/Antitrust Claims/RICO Claims <br />any actual or alleged liability arising out of any: <br />a. unfair competition, dilution, deceptive trade practices, or civil actions for consumer fraud; <br />b. charges of price fixing, monopolization or restraint of trade; or <br />c. any violation of: <br />L the Federal Trade Commission Act; <br />ii. the Sherman Act, the Clayton Act, or any federal statutory provision regarding anti-trust, <br />monopoly, price fixing, price discrimination, predatory pricing or restraint of trade; <br />iii. the Racketeer Influenced and Corrupt Organizations Act; <br />iv. any rules or regulations promulgated under or in connection with the above statutes; or <br />v. any state, federal or local statute or other law which similarly regulates business practices. <br />11. Uninsured/Underinsured Motorists <br />any actual or alleged liability arising out of any obligations under an uninsured/underinsured motorist <br />law, a personal injury protection law, a reparations benefit law or other similar law. <br />12. War <br />any actual or alleged liability arising, directly or indirectly out of any: <br />a. war, including undeclared or civil war; <br />b. warlike action by a military force, including action in hindering or defending against an actual or <br />expected attack, by any government, sovereign or other authority using military personnel or <br />other agents; or <br />c. insurrection, rebellion, revolution, usurped power, or action taken by governmental authority in <br />hindering or defending against any of these. <br />13. Workers' Compensation and Similar Laws /Nonsubscriber Status <br />any actual or alleged liability arising out of any obligation of any Insured: <br />a. under a workers' compensation, disability benefits or unemployment compensation law or any <br />similar law. <br />b. by reason of a statement of non -subscription on file with any applicable Worker's Compensation <br />authority of any State indicating the Named Insured has chosen not to participate in the <br />Workers Compensation system in accordance with laws of such state. <br />B. Coverage A - Excess Follow Form Liability Exclusions <br />With respect to Coverage A - Excess Follow Form Liability, this Insurance does not apply to: <br />1.
