A-2010-11 <br />AMENDMENT NO. 3 TO <br />AGREEMENT NO. C-8-0862 <br />BETWEEN <br />ORANGE COUNTY TRANSPORTATION AUTHORITY <br />AND <br />CITY OF SANTA ANA <br />FOR <br />RAIL -HIGHWAY GRADE CROSSING SAFETY ENHANCEMENTS <br />AND <br />SAFETY MEASURES RELATED TO QUIET ZONE IMPLEMENTATION FOR CITIES <br />THIS AMENDMENT NO. 3 is made and entered into this day of <br />20 , by and between the Orange County Transportation Authority, ("AUTHORITY"), and the City of <br />Santa Ana ("CITY"). <br />WHEREAS, by Agreement No. C-8-0862 dated October 20, 2008, as previously changed by <br />Amendment No. 2 dated July 6, 2010, AUTHORITY and CITY entered into a cooperative agreement <br />for the rail highway grade crossing safety enhancements and safety measures related to quiet zone <br />implementations; and <br />WHEREAS, AUTHORITY and CITY agree to extend the term of the agreement for ten (10) <br />months to June 30, 2013 to allow for project closeout; and <br />NOW, THEREFORE, it is mutually understood and agreed that Agreement No. C-8-0862 is <br />hereby amended in the following particulars only: <br />1. Amend ARTICLE 9. ADDITIONAL PROVISIONS, page 11 of 14, Paragraph B, as last <br />amended by Amendment No. 1 to delete "August 31, 2012", as the expiration date of the Agreement <br />and in lieu thereof, insert "June 30, 2013". <br />The balance of Agreement No. C-8-0862 remains unchanged. <br />
