HUD will allocate the amounts that <br />remain after the set -aside to territories under paragraph (a) of this section to States, <br />metropolitan cities, and urban counties, as follows: <br />(1) HUD will provide that the percentage of the total amount available for allocation to <br />each State, metropolitan city, or urban county is equal to the percentage of the total amount <br />available under section 106 of the Housing and Community Development Act of 1974 for the <br />prior fiscal year that was allocated to that State, metropolitan city, or urban county. <br />(2) Except as otherwise provided by law, if the amount a metropolitan city or urban <br />county would be allocated under paragraph (b)(1) is less than 0.05 percent of the total fiscal <br />year appropriation for ESG, that amount will be added to the allocation for the State in which <br />the city or county is located. <br />(c) Notification of allocation amount. HUD will notify each State, metropolitan city, urban <br />county, and territory that is eligible to receive an allocation under this section of the amount of <br />its allocation. <br />t Back to Top <br />Subpart B—Program Components and Eligible Activities <br />t Back to Top <br />§576.100 General provisions and expenditure limits. <br />(a) ESG funds may be used for five program components: street outreach, emergency <br />shelter, homelessness prevention, rapid re -housing assistance, and HMIS; as well as <br />administrative activities. The five program components and the eligible activities that may be <br />funded under each are set forth in §576.101 through §576.107. Eligible administrative <br />activities are set forth in §576.108. <br />(b) The total amount of the recipient's fiscal year grant that may be used for street <br />outreach and emergency shelter activities cannot exceed the greater of: <br />(1) 60 percent of the recipient's fiscal year grant; or <br />(2) The amount of Fiscal Year 2010 grant funds committed for homeless assistance <br />activities. <br />(c) The total amount of ESG funds that may be used for administrative activities cannot <br />exceed 7.5 percent of the recipient's fiscal year grant. <br />(d) Subject to the cost principles in 2 CFR part 200, subpart E, and other requirements in <br />this part, employee compensation and other overhead costs directly related to carrying out <br />street outreach, emergency shelter, homelessness prevention, rapid re -housing, and HMIS <br />are eligible costs of those program components.
