If the recipient is a State, the recipient may use an amount consistent with the <br />restrictions in §576.100 and §576.108 to carry out administrative activities through its <br />employees or procurement contracts. If the recipient is a State, and has been identified as <br />the HMIS lead by the Continuum of Care, the State may use funds to carry out HMIS <br />activities set forth in §576.107(a)(2). The recipient must subgrant the remaining funds in its <br />fiscal year grant to: <br />(1) Units of general purpose local government in the State, which may include <br />metropolitan cities and urban counties that receive ESG funds directly from HUD; or <br />(2) Private nonprofit organizations, provided that for emergency shelter activities the <br />recipient obtains a certification of approval from the unit of general purpose local government <br />for the geographic area in which those activities are to be carried out. <br />(b) Recipients other than States; subrecipients. The recipient, if it is not a State, and all <br />subrecipients may carry out all eligible activities through their employees, procurement <br />contracts, or subgrants to private nonprofit organizations. If the recipient is an urban county, it <br />may carry out activities through any of its member governments, so long as the county <br />applies to its members the same requirements that are applicable to local government <br />subrecipients under this part. <br />§576.203 Obligation, expenditure, and payment requirements. <br />(a) Obligation of funds. (1) Funds allocated to States. (i) Within 60 days from the date <br />that HUD signs the grant agreement with the State (or grant amendment for reallocated <br />funds), the recipient must obligate the entire grant, except the amount for its administrative <br />costs. This requirement is met by a subgrant agreement with, or a letter of award requiring <br />payment from the grant to, a subrecipient. <br />(ii) Within 120 days after the date that the State obligates its funds to a unit of general <br />purpose local government, the subrecipient must obligate all of those funds by a subgrant <br />agreement with, or a letter of award requiring payment to, a private nonprofit organization; a <br />hlips:/Ary ..ecfr.gov/cgi-bin/text-idx?node=pt24.3.576&rgn=div5 27158 <br />
