3/10/2021 Electronic Code of Federal Regulations (eCFR) <br />housing assistance; <br />(viii) Standards for determining how long a particular program participant will be provided <br />with rental assistance and whether and how the amount of that assistance will be adjusted <br />overtime; and <br />(ix) Standards for determining the type, amount, and duration of housing stabilization <br />and/or relocation services to provide to a program participant, including the limits, if any, on <br />the homelessness prevention or rapid re -housing assistance that each program participant <br />may receive, such as the maximum amount of assistance, maximum number of months the <br />program participant receive assistance; or the maximum number of times the program <br />participant may receive assistance. <br />(f) Participation in HMIS. The recipient must ensure that data on all persons served and <br />all activities assisted under ESG are entered into the applicable community -wide HMIS in the <br />area in which those persons and activities are located, or a comparable database, in <br />accordance with HUD's standards on participation, data collection, and reporting under a <br />local HMIS. If the subrecipient is a victim service provider or a legal services provider, it may <br />use a comparable database that collects client -level data over time (i.e., longitudinal data) <br />and generates unduplicated aggregate reports based on the data. Back to Top <br />§576.401 Evaluation of program participant eligibility and needs. <br />(a) Evaluations. The recipient or its subrecipient must conduct an initial evaluation to <br />determine the eligibility of each individual or family's eligibility for ESG assistance and the <br />amount and types of assistance the individual or family needs to regain stability in permanent <br />housing. These evaluations must be conducted in accordance with the centralized or <br />coordinated assessment requirements set forth under §576.400(d) and the written standards <br />established under §576.400(e). <br />(b) Re-evaluations for homelessness prevention and rapid re -housing assistance. (1) <br />The recipient or subrecipient must re-evaluate the program participant's eligibility and the <br />types and amounts of assistance the program participant needs not less than once every 3 <br />months for program participants receiving homelessness prevention assistance, and not less <br />than once annually for program participants receiving rapid re -housing assistance. At a <br />minimum, each re-evaluation of eligibility must establish that: <br />(i) The program participant does not have an annual income that exceeds 30 percent of <br />median family income for the area, as determined by HUD; and <br />(ii) The program participant lacks sufficient resources and support networks necessary to <br />retain housing without ESG assistance. <br />https://www.ecfr.gov/cgi-bin/text-idx?node=pt24.3.576&rgn=div5 34158 <br />
