C-1-3289 <br />WHEREAS, the CITY of Santa Ana has requested an amendment to the MPAH as set forth in <br />Exhibit A, entitled "Amendment to the MPAH," attached to and, by this reference, incorporated in and <br />made a part of this MOU; and <br />WHEREAS, traffic analyses conducted as part of the MPAH amendment process determined that <br />the Amendment to the MPAH would result in projected changes to future traffic patterns; and <br />WHEREAS, these projected changes in future traffic patterns results in a determination that <br />appreciable impacts may occur in the CITIES and City of Orange; and <br />WHEREAS, CITIES have established Level of Service (LOS) "D" as their minimum acceptable <br />LOS and an appreciable impact is defined as an increase in Intersection Capacity Utilization (ICU) of <br />0.01, or otherwise adopted by the respective CITY, for intersections currently operating at an <br />unacceptable LOS; and <br />WHEREAS, Exhibit B, entitled "Summary of MPAH Amendment Appreciable Impacts and Traffic <br />Share," provides a summary of the appreciable impacts occurring at intersections as a result of the <br />Amendment to the MPAH (in ICU for city -controlled facilities and Highway Capacity Manual [HCMj for <br />state-controlled facilities); and <br />WHEREAS, the CITIES of Fountain Valley and Tustin and City of Orange are <br />"Affected Agencies," having appreciable impacts occurring within their jurisdictions as a result of the <br />CITY of Santa Ana's Amendment to the MPAH; and <br />WHEREAS, the City of Orange is also an Affected Agency because the CITY of Santa Ana's <br />Amendment to the MPAH includes reclassifying a roadway shared between the CITY of Santa Ana and <br />City of Orange, Fairhaven Avenue between Grand Avenue to Tustin Street; and <br />WHEREAS, both the CITY of Santa Ana and City of Orange must amend their respective General <br />Plans and comply with the California Environmental Quality Act (CEQA) to finalize the Fairhaven Avenue <br />amendment per the Guidance to the MPAH; and <br />WHEREAS, the Affected Agencies have reviewed the CITY of Santa Ana's Amendment to the <br />11'd■ -71 <br />Page 2 of 16 <br />
