MEMORANDUM OF UNDERSTANDING NO. C-1-3289 <br />1 (50%) by the CITY of Santa Ana and fifty percent (50%) by CITY of Fountain Valley. <br />2 2. Red Hill Avenue and Warner Avenue: This intersection is shared with the <br />3 CITY of Tustin. The CITY of Santa Ana shall monitor the Red Hill Avenue and <br />4 Warner Avenue intersection every two (2) years, and shall provide the monitoring <br />5 results to the CITY of Tustin. Monitoring shall begin two (2) years after the MOU is <br />6 executed. Prior to the ICU LOS at the intersection of Red Hill Avenue and <br />7 Warner Avenue exceeding the pre -amendment to the MPAH ICU LOS of 0.88, D the <br />8 CITY of Santa Ana shall fund the cost of the Red Hill Avenue and Warner Avenue <br />9 improvement. <br />10 G. The CITY of Santa Ana shall maintain funding availability, for a minimum of ten (10) years, <br />11 to contribute their fair share cost allocation to the agency leading the mitigation improvement, as identified <br />12 in Exhibit D, at the State Route (SR)-55 Northbound Ramps/Del Amo Avenue and Newport Avenue <br />13 intersection. The CITY of Santa Ana shall incorporate cost changes, which may include cost changes <br />14 based on the California Construction Cost Index or the County of Orange's assessment of land value, at <br />15 the time of mitigation improvement implementation. This funding shall be provided to the agency leading <br />16 and implementing the improvement at this intersection. <br />17 H. The CITY of Santa Ana shall provide status reports to AUTHORITY on the progress of <br />is the cooperative transit study and subsequent implementation of transit improvements and strategies, per <br />19 Article 4 Subsections C and D, every odd year through the MPAH Certification Review Process of the <br />20 Measure M2 Eligibility Submittal. <br />21 ARTICLE 5. RESPONSIBILITIES OF THE CITY OF FOUNTAIN VALLEY: <br />22 The CITY of Fountain Valley agrees to the following responsibilities: <br />23 A. The CITY of Fountain Valley enters into this MOU to implement mitigation improvement(s) <br />24 at the Euclid Street and Edinger Avenue intersection, as identified in Exhibit D. The improvement(s) is <br />25 not meant to be prescriptive. If an alternative improvement, which meets the overall objective of achieving <br />26 and/or maintaining the pre -amendment to the MPAH ICU, is identified then that improvement shall be <br />considered acceptable and shall be implemented as a substituted solution if there is agreement amongst <br />Page 9 of 16 <br />
