2. No Park Owner shall require any Mobilehome Owner/Legal Owner to waive his or her rights <br />to relocation assistance as a condition of renting a space in the Mobilehome Park. It shall be <br />against public policy to subvert any provisions of this Chapter by coercing the waiver of any <br />rights or privileges created or protected thereby. Any provision of a lease agreement which <br />purports directly or indirectly to waive or require waiver of the rights of a Mobilehome <br />Owner/Legal Owner under this section or which requires prior consent to the conversion, <br />closure, or cessation of use of land as a Mobilehome Park shall be null, void, and unenforceable. <br />3. Mobilehome Owners/Legal Owners eligible for relocation assistance shall be entitled to the <br />assistance required by the Rent Board as a condition of Change of Use even if they vacate from <br />the Mobilehome Park before the Rent Board's final determination concerning required relocation <br />assistance. <br />Q. Additional Protections <br />1. Right of Negotiated Purchase: In the event a Park Owner notifies Mobilehome <br />Owners/Legal Owners/Residents of a proposed Park conversion, the Mobilehome Owner/Legal <br />Owner/Residents shall have the right to negotiate purchasing the Park. If the Mobilehome <br />Owner/Legal Owner/Resident so acts, then all action on the conversion is halted for 180 days <br />and the City of Santa Ana shall assign a mediator to facilitate purchase negotiations. <br />a. Right of First Refusal: In the event of a Park conversion, the Mobilehome <br />Owner/Legal Owner/Resident shall have the right of first refusal to purchase/lease/rent <br />the housing at the Park premises after conversion. <br />2. Denial of Permit for Coercion: A permit for Park conversion may be denied where there <br />is is substantial or credible evidence that the Park Owner has coerced Mobilehome Owners/Legal <br />Owners/Residents to publicly support or approve closure, proposed conversion of a Mobilehome <br />Park to another use, or cessation of the use of land as a Mobilehome Park, or to refrain from <br />publicly opposing the same, or to forego any assistance to which they might be entitled. <br />3. Rights of Mobilehome Owners/Legal Owners/Residents/Tenants: Mobilehome <br />Owners/Legal Owners/Residents/Tenants in a Park proposed for conversion have the following <br />rights: <br />a. Right to terminate a lease or rental agreement, without penalty, upon 60 days' <br />notice to the Landlord. <br />b. No increase in rent until the termination of a lease/rental agreement, or until 12 <br />months after the date of issuance of the final public report, or expiration of Lease, <br />whichever is longer. <br />C. No unjust eviction during tenancy. <br />d. No coercion or retaliatory action against such Mobilehome Owner/Legal <br />Owner/Tenant/Resident, including pressure to support, or refrain from opposing, a <br />conversion project. <br />82 <br />
