The City Attorney shall take all steps necessary to zealously defend against any legal challenges <br />to the validity of this Chapter. If the City Attorney is unable or unwilling to defend, an interested <br />third party may intervene to defend. Any third party that defends this Chapter shall be entitled to <br />court awarded attorney's fees and costs. <br />SECTION 24 CEQA COMPLIANCE <br />This action is exempt from the California Environmental Quality Act (CEQA) pursuant to <br />sections of the CEQA Guidelines, taken together and each as a separate and independent basis, <br />including, but not limited to: Section 15378 (regulatory actions), Section 15060(c)(2) (no direct <br />or reasonably foreseeable indirect physical change in the environment), and Section 15061(b)(3) <br />(no significant environmental impact). The legislation contains no provisions modifying the <br />physical design, development, or construction of residential or nonresidential structures. <br />Accordingly, it can be seen with certainty that there is no possibility that it: (1) may have a <br />significant effect on the environment or (2) would result in any physical changes to the <br />environment. <br />SECTION 25 MAJORITY APPROVAL, EFFECTIVE DATE, EXECUTION <br />This Ordinance shall be effective only if approved by a majority of the voters voting thereon and <br />shall go into effect ten (10) days after the vote is declared by the City Council. The Mayor and <br />City Clerk are hereby authorized to execute this Ordinance to give evidence of its adoption by <br />the voters. <br />86 <br />
