providing at least thirty (30) days' written notice to the Tenant of the Rent Increase pursuant to <br />California Civil Code section 827, as may be amended. A Landlord may not impose an annual <br />Rent Increase, unless the Covered Rental Unit or Mobilehome is registered with the Rent Board <br />and not delinquent in registration payments pursuant to Rent Board regulations. This Section <br />shall limit annual Rent as follows: <br />A. If the change in CPI is three percent (3%), or higher, the annual maximum allowable <br />Rent Increase will be equivalent to 80% of the percentage increase in CPI or three <br />percent (3%), whichever is lower; <br />B. If the change in CPI is between one percent (1%) and three percent (3%), the <br />maximum allowable Rent increase will be equal to 80% of the percentage increase in <br />CPI. <br />C. If the change in CPI is negative, no rent increase is permitted. <br />D. Where a Tenant, Mobilehome Owner, or Resident has already paid Rent in excess of <br />three percent (3%) above the Rent charged on February 25, 2020, the Landlord shall <br />credit the Tenant, Mobilehome Owner, or Resident the balance of the overpayment. The <br />Landlord may either: (a) pay the Tenant, Mobilehome Owner, or Resident the balance of <br />the overpayment directly in one lump sum, or (b) give the Tenant, Mobilehome Owner, or <br />Resident a credit against the Rent otherwise due from the Tenant, Mobilehome Owner, or <br />Resident to the Landlord over a six-month period. For any Covered Rental Unit or <br />Mobilehome where the Landlord has not increased the Rent for a particular Tenant, <br />Mobilehome Owner, or Resident by the maximum allowable rate of three percent (3%) of <br />the Rent charged on February 25, 2020, the Landlord may only increase the Rent for that <br />particular Tenant, Mobilehome Owner, or Resident, following the effective date of this <br />Ordinance by an amount that when added to the amount of any Rent increase noticed on <br />or after February 25, 2020, does not exceed three (3%) of the monthly Rent charged on <br />February 25, 2020, or of the initial Rent charged, if the tenancy began after February 25, <br />2020. <br />(3) No Banking, A Landlord who refrains from imposing an annual rent increase or any portion <br />thereof may not accumulate said increase and impose that amount on the Tenant's/Resident's <br />subsequent rent increase anniversary dates. <br />(4) One Rent Increase Per Year. No more than one rent increase may be imposed on a Tenant <br />household in any twelve-month period following the effective date of the Ordinance. <br />(5) Postine. As soon as the Landlord is aware of the maximum allowable rent as posted by the <br />Rent Board, the Landlord shall post it for each Covered Rental Unit or Rental Unit/Dwelling, or <br />Mobilehome space. <br />53 <br />
