Notwithstanding anything to the <br />contrary herein, City shall provide Developer's limited partner with a copy of any notice <br />of detaudt delivered to Developer heretmder, and acknowledge; and agree, that <br />Developers limited partner shall have a right to cure any such detault on the same basis <br />as I;orrowcr. <br />21 _ MISCELLANEOUS <br />21.1 Obligations Unconditional and Independent. Notwithstanding the <br />existence at any time of any Obligation or liability of City to Developer, or any other <br />claim by Developer against City, in connection with the Loan or otherwise, Developer <br />hereby waive, any right it might otherwise have (a) to olTset any such obligation, liability <br />or claim against Dcvcluper', obligations under the Loan DU(alirtenh, ur (b) to claim that <br />the existence ofanv such outstanding obligation, Iiabilityor claim excuses the <br />nonperformance by Developer of any of ils obligations under the Loan Documents. <br />212 Notices.
