Warner Ave, Santa Ana, CA 92705 <br />DEED NUMBER <br />yZo�Y�i� i171 <br />TEMPORARY CONSTRUCTION EASEMENT DEED <br />FOR VALUABLE CONSIDERATION, receipt of which is hereby acknowledged, <br />Wiliz Investment, LLC ("Grantor") <br />Does Hereby Grant to the CITY OF SANTA ANA, a charter City and municipal corporation duly organized <br />under the Constitution and laws of the State of California ("Grantee"). <br />A Temporary Construction Easement over that real property in the City of Santa Ana, Orange County, <br />State of California described in Exhibit "A" and shown in Exhibit "B" (the "Servient Tenement"), which <br />exhibits are attached hereto and by this reference made a part hereof. The temporary construction <br />easement granted herein shall terminate on completion of the construction work, consisting of <br />improvements to a public thoroughfare located on Wamer Avenue in the City of Santa Ana, for a <br />term not to exceed six (6) months from the date of execution of this Temporary Construction <br />Easement Deed. <br />The easement granted herein is a temporary right to enter upon the Servient Tenement to cross <br />over the Servient Tenement in connection with the performance of certain construction work on <br />Warner Avenue, situated adjacent to the Servient Tenement. At all times, Grantee shall not engage <br />in any conduct which denies access to the Servient Tenement nor causes the interruption of utility <br />services, including but not limited to, water, sewer, gas, electrical and telephone to the Servient <br />Tenement. Grantee shall not impede access for tenants at location and shall not allow storage of <br />equipment or materials on the property throughout the term of the Temporary Construction <br />Easement. <br />Within fifteen (15) days following completion of the construction work, Grantee shall repair any <br />and all damage it caused to the Servient Tenement. <br />Grantee shall hire only licensed contractors who cant' workers compensation insurance and <br />liability coverage for personal injury and property damage. Furthermore, Grantee shall not cause <br />to be recorded any Mechanic's Liens on Grantor's property. Grantee shall indemnify, defend, and <br />hold harmless, the Grantor and Grantor's members, managers, agents, tenants, successors, <br />heirs, and assigns for any and all claims arising from Grantee's use of the Servient Tenement. <br />
