Resolution No. 2021-02 <br />Page 2 of 7 <br />subject property of privileges not otherwise at variance with the intent <br />and purpose of the provisions of this chapter. <br />There are special circumstances applicable to the subject property <br />related to the location and surroundings. The church is located along <br />Edinger Avenue, a major arterial street. The front of the church <br />building has several glass floor to ceiling window and doors which <br />allow for direct access into the church, if broken. Vehicles are able to <br />park along Edinger Avenue which provides easy access to and from <br />the site. In a recent burglary incident, surveillance footage shows the <br />suspect parking along the south side of Edinger Avenue, entering the <br />building and fleeing from the building to their vehicle for a quick <br />getaway. Additionally, in recently documented burglary and <br />vandalism incidents suspects are seen standing on the property <br />along Edinger Avenue and throwing rocks at the windows and doors. <br />Furthermore, the intent of the fence height regulations is to reduce <br />the fortress like appearance that walls and fences can create. <br />However, there are several other properties along Edinger Avenue <br />between Harbor Boulevard and Newhope Street, including the <br />property directly to the west that have a fence over four feet in height <br />on the property line. Landscaping will also be maintained in front of <br />the proposed fence to soften the height in the front yard. Therefore, <br />the fence will not be out of character or scale with the surrounding <br />properties. <br />2. That the granting of a minor exception is necessary for the <br />preservation and enjoyment of one or more substantial property <br />rights. <br />Granting the minor exception is necessary for the preservation and <br />enjoyment of substantial property rights as approval of this minor <br />exception maintains the rights of the property owner and church <br />members to safely and freely utilize the property. Recently, the <br />property has experienced burglary and vandalism incidents and the <br />Santa Ana Police Department, Orange County Sheriff’s Department <br />Orange County Intelligence Assessment Center, and United States <br />Department of Homeland Security all recommended the installation of <br />a seven-foot high fence in the front yard to secure the church <br />property. The view of the church building will not be obstructed as the <br />fence has been designed to maintain visibility into the site as required <br />by the Police Department and Orange County Fire Authority. <br />3. That the granting of a minor exception will not be materially <br />detrimental to the public welfare or injurious to surrounding property. <br />The granting of this minor exception will not be detrimental to the <br />public or surrounding properties.
