letters are sent to mitigate any adverse effect on <br />the Named Insured's or its Subsidiary's <br />reputation with customers, investors and <br />employees resulting from a Privacy Breach that <br />becomes public; and <br />5. Data analysis or forensic investigation to assess <br />the scope of a Privacy Breach; and <br />6. Development of a website link for use by the <br />Named Insured or its Subsidiary, as applicable, <br />in communicating with persons affected by a <br />Privacy Breach after notification letters are sent; <br />and <br />7. Development and support of a Customer <br />Relationship Management (CRM) system and <br />call center for use by the Named Insured or its <br />Subsidiary, as applicable, in communicating <br />with persons affected by a Privacy Breach after <br />notification letters are sent; and <br />8. Credit monitoring services for up to one year (or <br />more if required by law) following a Privacy <br />Breach; and <br />9. The cost for Data Asset restoration resulting <br />from the intentional or willful destruction of a <br />Data Asset, but not including: <br />a. the cost to update or improve any Data Asset <br />or computer system to a level beyond that <br />which existed prior to such intentional or <br />willful destruction of a Data Asset; or <br />b. the economic or market value of any Data <br />Asset. <br />The above costs are subject to the limit of expense <br />coverage for "each Privacy Breach" and "in the <br />aggregate" for Privacy Breach Expense shown above. <br />Privacy Law means a federal or state statute or regulation governing <br />the confidentiality, access, control, and use of <br />Personally Identifiable Information. <br />Regulatory Notice/Proceeding means a request for information, civil investigation, civil <br />proceeding or other similar proceeding directed to an <br />Insured and brought by or on behalf of any federal, state <br />or local regulatory agency, related to an actual or alleged <br />violation of any Privacy Law.
