INSURANCE NOT ON FILE A-2021-118-01A <br />WORK MAY NOT PROCEED <br />CLERK OF COUNCIL <br />DATE: <br />N <br />N FIRST AMENDMENT TO AGREEMENT WITH DESIGN PATH STUDIO <br />o TO PROVIDE PRE -APPROVAL ACCESSORY DWELLING UNIT PLANS <br />i <br />n THIS FIRST AMENDMENT to the above -referenced agreement is entered into on August 16, <br />2021, by and between Design Path Studio ("Consultant"), and the City of Santa Ana, a charter city <br />and municipal corporation organized and existing under the Constitution and laws of the State of <br />California ("City"), collectively referred to as the "Parties". <br />0.. p1w. ` (,gotta A6orad;e,,�$M) $ RECITALS <br />A. The Parties entered into Agreement No. A-2021-118-01, dated July 6, 2021, by which <br />Consultant agreed to create and develop accessory dwelling unit building plan sets for <br />expedited permit processing and construction ("Agreement"). The term of the Agreement is <br />for a three-year term through July 5, 2024, with an option to extend the term of the Agreement. <br />The Agreement is current and in effect. <br />B. Upon commencement of services by the Consultant, the City requested additional services to be <br />provided by the Consultant consistent with the Request for Proposal referenced in the Agreement <br />and the terms of the Agreement approved by the City Council on July 6, 2021. <br />C. The Parties now wish to amend the scope of services and compensation to be provided under <br />the Agreement. These amendments will not increase the overall compensation detailed under <br />the terms of this Agreement. <br />The Parties therefore agree: <br />1. Section 1, Scope of Services, is amended to replace the existing Project Schedule in its entirety <br />with the Project Schedule attached hereto as Exhibit A-1. <br />2. Section 2, Compensation, is amended to replace Exhibit B in its entirety with the Cost <br />Proposal, dated August 4, 2021, attached hereto as Exhibit B-1. <br />3.
