Planning and Building Agency <br />Item # 3 <br />City of Santa Ana <br />20 Civic Center Plaza, Santa Ana, CA 92701 <br />Planning Commission Staff Report <br />February 8, 2021 <br />Topic: CUP No. 2020-23 – Sushi 21 Express On-Premises ABC License <br />RECOMMENDED ACTION <br />Adopt a resolution approving Conditional Use Permit No. 2020-23 as conditioned. <br />EXECUTIVE SUMMARY <br />Mike Kuark with Sushi 21 Express Restaurant, on behalf of property owner D&S <br />Investments, is requesting approval of Conditional Use Permit (CUP) No. 2020-23 to <br />allow the sale of alcoholic beverages for on premise consumption at an existing <br />restaurant located at 3701 South Harbor Boulevard, Unit E. Pursuant to Section 41-196 <br />of the Santa Ana Municipal Code (SAMC), establishments wishing to sell alcoholic <br />beverages for on-premises consumption require approval of a CUP. Staff is <br />recommending approval of the applicant’s request because the project has <br />demonstrated compliance with zoning requirements as discussed and analyzed in the <br />sections below, because the site is located away from sensitive uses, and due to the <br />property’s history of compliance with City codes and regulations. <br />DISCUSSION <br />Project Description <br />Sushi 21 Express currently occupies a 1,616-square foot tenant space within a multi- <br />tenant commercial building. The restaurant will accommodate up to 26 patrons within its <br />dining area and will operate Monday through Saturday from 10:00 a.m. to 12:00 a.m. <br />(midnight). With the approval of the Conditional Use Permit, the applicant intends to <br />apply for a Type 41 (Beer & Wine) Alcohol Beverage Control (ABC) license ancillary to <br />the food service on premise. All alcoholic beverages will be stored within the <br />restaurant’s cooler, storage racks and service counter area, which will be less than 60 <br />square feet in size combined. Both the storage and display areas will make up less than <br />five percent of the total restaurant’s floor area as required by SAMC Section 41- <br />196(g)(25). No entertainment is being proposed at this time. Should the applicant seek <br />to provide entertainment, approval of an entertainment permit will be required.
