jmf 8-31-21 <br /> <br />RESOLUTION NO. 2021-XXX <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SANTA ANA APPROVING A SECOND ONE-YEAR <br />EXTENSION OF CONDITIONAL USE PERMIT NO. 2017-29 <br />AND VARIANCE NO. 2017-07 FOR THE HAMPTON INN <br />HOTEL DEVELOPMENT TO BE LOCATED AT 2129 <br />NORTH MAIN STREET <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS <br />FOLLOWS: <br />Section 1. The City Council of the City of Santa Ana hereby finds, determines <br />and declares as follows: <br />A. On February 20, 2018, the City Council affirmed the Planning Commi <br />recommendation to approve Conditional Use Permit No. 2017-29 and <br />Variance No. 2017-07 to allow the development of a six-story, 135-room <br />hotel development at 2129 North Main Street. On February 20, 2020, the <br />applicant requested an extension of the entitlements. <br />B. On March 17, 2020, the City Council adopted a resolution approving the <br />first of three possible one-year entitlement extensions for the project. <br />Shortly thereafter, a state of local emergency was declared stemming from <br />the COVID-19 pandemic. Successive executive orders extended the <br />expiration date from February 20, 2021 to August 20, 2021. <br />C. Due to difficulties in securing funding for hospitality projects such as the <br />proposed hotel stemming from the global COVID-19 pandemic, the <br />applicant has been unable to move forward with the development and is <br />requesting a second extension for the conditional use permit and variance. <br />Ino more than one-year <br />extensions at a time, mainly in an effort to encourage the construction of <br />previously approved projects. <br />D. Upon the securing of funding for the project, the applicant intends to <br />obtain all necessary building permits for the project. The plans for the <br />project have completed the plan check phase of development and are <br />ready for permit issuance. The applicant expects to obtain permits and <br />start construction later this year. <br />E. Pursuant to City of Santa Ana Municipal Code Section 41-647, where <br />construction does not commence, these types of entitlements expire after <br />two (2) years unless the applicant applies for, and the City Council <br />approves, an extension.
