Organizations and Food Recovery Services are not Commercial Edible Food Generators.
<br />1.20 Commercial Premises
<br />"Commercial Premises" means Premises upon which business activity is conducted, and
<br />any other premises not defined as Residential Premises per Section 1.70 of this
<br />Agreement, including but not limited to retail sales, services, wholesale operations,
<br />manufacturing and industrial operations, but excluding Residential Premises upon
<br />which business activities are conducted when such activities are permitted under
<br />applicable zoning regulations and are not the primary use of the property.
<br />Notwithstanding any provision to the contrary herein, in the Santa Ana Municipal
<br />Code, or otherwise, for purposes of this Agreement, Premises upon which the following
<br />uses (as defined in the Santa Ana Municipal Code) are occurring shall be deemed to be
<br />Commercial Premises: Assisted Living Facilities, Convalescent Homes, Dormitories,
<br />Extended Stay Motels, Group Residential Facilities, Group Care Facilities, Hotels, and
<br />Motels.
<br />1.21 Construction and Demolition Debris
<br />"Construction and Demolition Debris" or "C&D Material," means any combination of
<br />inert building materials and Solid Waste resulting from construction, remodeling,
<br />repair, cleanup, or demolition operations as defined in California Code of Regulations,
<br />Title 22 Section 66261.3 et sea. This term includes, but is not limited to, asphalt,
<br />concrete, Portland cement concrete, brick, lumber, gypsum wallboard, cardboard, and
<br />other associated packaging; roofing material, ceramic tile, carpeting, plastic pipe and
<br />steel. The material may be commingled with rock, soil, tree stumps; and other
<br />vegetative matter resulting from land clearing and landscaping for construction or land
<br />development projects.
<br />1.22 Containers
<br />"Containers" means any and all types of Solid Waste receptacles, including Carts, Bins,
<br />and Roll -off Boxes.
<br />1.23 Contractor
<br />"Contractor" means Republic Waste Services of Southern California, LLC, and its
<br />officers, directors, employees, agents, companies and Subcontractors.
