12.17 Compliance with Municipal Code <br />Contractor shall comply with those provisions of the municipal code of City which are <br />applicable, and with any and all amendments to such applicable provisions during the <br />term of this Agreement. <br />12.18 Privacy <br />Contractor shall strictly observe and protect the rights of privacy of Customers. <br />Information identifying individual Customers or the composition or contents of a <br />Customer's waste stream shall not be revealed to any Person, governmental unit, <br />private agency, or company, unless upon the authority of a court of law, by statute, or <br />upon valid authorization of the Customer. This provision shall not be construed to <br />preclude Contractor from preparing, participating in, or assisting in the preparation of <br />waste characterization studies or waste stream analyses which may be required by AB <br />939. This provision shall not apply to reports or records provided to City pursuant to <br />this Agreement so long as City maintains reports or records with Customer <br />identification or confidential information in accordance with this section, in which case <br />this section shall apply to City in the same manner to which it applies to Contractor. <br />12.19 Cooperation Following Termination <br />At the end of the Term or in the event this Agreement is terminated for cause prior to <br />the end of the Term, Contractor shall cooperate fully with City and any subsequent <br />Contractor to assure a smooth transition of Solid Waste management services. <br />Contractor's cooperation shall include, but not be limited to, providing operating <br />records needed to service all properties covered by this Agreement. The failure to <br />cooperate with City following termination shall be conclusively presumed to be <br />grounds for specific performance of this covenant and/or other equitable relief <br />necessary to enforce this covenant. <br />12.20 Compliance with Immigration Laws. <br />Contractor shall be knowledgeable of and comply with all local, state and federal laws <br />which may apply to the performance of this Agreement. Contractor warrants and <br />represents that all of its employees, including any and all prospective employees hired <br />to perform services for the City under this Agreement and the employees of any <br />Subcontractor retained by the Contractor to perform a portion of the services under this <br />August 17, 2021 170 City of Santa Ana <br />
