Agreement, Edible Food is not Solid Waste if it is recovered and not discarded. Nothing <br />in this Agreement requires or authorizes the recovery of Edible Food that does not meet <br />the food safety requirements of the California Retail Food Code. If the definition in 14 <br />CCR Section 18982(a)(18) for Edible Food differs from this definition, the definition in <br />14 CCR Section 18982(a)(18) shall apply to this Agreement. <br />1.34 Electronic Waste or E-Waste <br />"Electronic Waste" or "E-Waste' means electronic equipment and includes, but is not <br />limited to, stereos, televisions, computers and computer monitors, VCRs, cellular <br />phones, fax machines, household copiers, computer printers, other electronic items with <br />electric plugs that are banned from landfilling, and other similar items commonly <br />known as "brown goods." <br />1.35 Environmental Law <br />"Environmental Law" means any federal and state statute, county, local and City <br />ordinance, rule, regulation, order, consent decree, judgment or common-law doctrine, <br />and provisions and conditions or permits, licenses and other operating authorizations <br />relating to (i) pollution or protection of the environment, including natural resources, <br />(ii) exposure of Persons, including employees, to Hazardous Materials or other <br />products, raw materials, chemicals or other substances, (iii) protection of the public <br />health or welfare from the effects of by-products, wastes, emissions, discharges or <br />releases of chemical substances from industrial or Commercial activities, or (iv) <br />regulation of the manufacture, use or introduction into commerce of chemical <br />substances, including, without limitation, their manufacture, formulation, labeling, <br />distribution, transportation, handling, storage and Disposal. <br />1.36 Excluded Waste <br />"Excluded Waste" means Hazardous Substance, Hazardous Waste, infectious waste, <br />Designated Waste, volatile, corrosive, biomedical, infectious, biohazardous, and toxic <br />substances or material, waste that Contractor reasonably believes would, as a result of <br />or upon Disposal, be a violation of local, State or Federal law, regulation or ordinance, <br />including land use restrictions or conditions, waste that cannot be Disposed of in Class <br />III landfills, waste that in Contractor's reasonable opinion would present a significant <br />risk to human health or the environment, cause a nuisance or otherwise create or expose <br />Contractor or City to potential liability; but not including de minimis volumes or <br />August 17, 2021 11 City of Santa Ana <br />
