ARTICLE 4 <br />DIRECT SERVICES <br />4.1 Services to be Provided by Contractor - General <br />The work to be done by Contractor pursuant to this Agreement shall include, but not be <br />limited to, the furnishing of all labor, supervision, equipment, materials, supplies, and <br />all other items necessary to perform the services required. The enumeration of, and <br />specification of requirements for, particular items of labor or equipment shall not <br />relieve Contractor of the duty to furnish all others, as may be required, whether <br />enumerated elsewhere in the Agreement or not. <br />The work to be done by Contractor pursuant to this Agreement shall be accomplished <br />in a thorough and professional manner so that Customers within City are provided <br />reliable, courteous and high -quality Solid Waste Handling Services at all times. The <br />enumeration of, and specification of requirements for, particular aspects of service <br />quality shall not relieve Contractor of the duty of accomplishing all other aspects in the <br />manner provided in this section, whether such other aspects are enumerated elsewhere <br />in the Agreement or not. <br />4.2 Residential Curbside Service Unit Services <br />Residential Refuse, Recyclables, and Organics Processing, Transfer, and Collection shall <br />be in accordance with Exhibit 8 and Exhibit 9 of this Agreement. <br />4.2.1 Residential Curbside Service Unit Refuse Collection <br />Contractor shall provide all Residential Curbside Service Unit Customers with one 96- <br />gallon Refuse Cart. Customers may request a smaller 64-gallon or 35-gallon Refuse Cart. <br />See Section 4.7.4.1 for Cart selection procedures. Additional Refuse Carts may be <br />requested for a monthly fee per Cart in accordance with the approved rate schedule. <br />Collection frequency shall be not less than once per week from Contractor -provided <br />Refuse Carts placed at a suitable location, which is typically on the street adjacent to the <br />curb or along an alley with street access at both ends, unless otherwise approved by the <br />Executive Director. If there is a dispute between a Customer and Contractor as to <br />whether Refuse Cart or Bin Service shall be provided, or the proper location for Refuse <br />Cart placement, City will make the final determination. <br />August 17, 2021 40 City of Santa Ana <br />
