OF COUNCIL <br />DATE <br />N-2019-248A <br />RENEWAL OF PREA AUDITING SERVICES AGREEMENT WITH <br />EVINGER & ASSOCIATES FOR POLICE DEPARTMENT JAIL FACILITY <br />O'��clice (da+�.r-tnvit��ut��U�r.i, <br />This renewal of services is between SANTA ANA, CA ("City") acting by and through its Police <br />Department and EVINGER & ASSOCIATES, LLC ("Contractor") and is made and entered into <br />on this 27th day of September, 2021. <br />c RECITALS <br />04 <br />A. All confinement facilities covered under the Prison Rape Elimination Act (PREA) <br />® standards must be audited at least every three years to be considered compliant with the <br />PREA standards, with one third of each facility type operated by an agency, or private <br />organization on behalf of an agency, audited each year. These include adult prisons and <br />jails, juvenile facilities, lockups (housing detainees overnight), and community <br />confinement facilities, whether operated by the Department of Justice or unit of a state, <br />local, corporate, or nonprofit authority. <br />B. The parties previously entered into an Agreement #N-2019-248 ("Agreement') on <br />November 1, 2019, for said services with a termination date of July 31, 2020, attached <br />hereto as Exhibit A. <br />C. Due to the ongoing global pandemic caused by COVID-19, Contractor was unable to <br />complete the services detailed in the Agreement, which expired on July 31, 2020. <br />D. The parties agree the services detailed in the Agreement are still required by the City and <br />Contractor is willing and able to complete the contracted for services. <br />E. The parties agree to renew only the term of the Agreement to provide for the expiration of <br />the Agreement to December 31, 2021, with all other terms and conditions previously <br />agreed to remain the same. <br />THEREFORE THE PARTIES AGREE TO THE FOLLOWING: <br />1. Contractor will complete all services detailed in the Agreement, attached hereto as Exhibit <br />A by December 31, 2021. <br />2. The City will recognize services provided by Contractor from August 1, 2020, through <br />December 31, 2021. <br />The parties agree to abide by all remaining prior terms and conditions detailed in Exhibit <br />A and that all other terms and conditions set forth in the Agreement remain unchanged. <br />The parties expressly acknowledge, understand and agree there will be no changes Section <br />II(d)-Auditor Fees and no increase in compensation owed by the City to Contractor with <br />the renewal of this Agreement. <br />PREA AUDITING SERVICES — RENEWAL AGREEMENT <br />WITH EVINGER AND ASSOCIATES <br />
