ORDINANCE NO. NS-XXX <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF SANTA ANA, CALIFORNIA, AMENDING SECTION 36- <br />400 OF CHAPTER 36OF THE SANTA ANA MUNICIPAL <br />CODEREGARDING THE LOCATION OF PARKING <br />METERS <br />THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS <br />FOLLOWS: <br />Section 1. The City Council of the City of Santa Ana hereby finds, determines, <br />and declares as follows: <br />A.Currently, Santa Ana Municipal Code Section 36-400 requires all <br />parking meters to be placed upon the curb alongside of and next to <br />parking spaces; <br />B.Class IV (protected) bikeways have a raised median separating the <br />parking space and the bikeway from the sidewalk; and <br />C.The useof protected bikeways requires modification of Santa Ana <br />Municipal Code Section 36-400 to allow parking meters to be placed on <br />the sidewalk adjacent to parking spaces. <br />Section 2.Section 36-400of Articleof Chapter 36 <br />of the Santa Ana Municipal Code is hereby amended to read as follows(new language <br />isunderlinedand deleted language is stricken): <br />Sec. 36-400. -Location onsidewalkcurb; space markings. <br />All parking meters shall be placed upon thesidewalkcurbalongside ofadjacent <br />parking spaces orandnext to parking spaces. Such parking spaces shall be of <br />sufficient sizeto accommodate an automobile and shall indicate parallel or diagonal <br />parking by painted lines on the pavement. <br />Section 3.If any section, subsection, sentence, clause, phrase or portion of this <br />ordinance is for any reason held to be invalid or unconstitutional by the decision of any <br />court of competent jurisdiction, such decision shall not affect the validity of the <br />remaining portions of this ordinance. The City Council of the City of Santa Ana hereby <br />declares that it would have adopted this ordinance andeach section, subsection, <br />sentence, clause, phrase or portion thereof irrespective of the fact that any one or more <br />sections, subsections, sentences, clauses, phrases, or portions be declared invalid or <br />unconstitutional. <br />Ordinance No. NS-XXX <br />Page 1 of 2 <br /> <br />
