riSURANCE ON FILE N-2021-207-01 <br />b� UNTIL INSURANCE EXPIRES <br />WORK MAY PROCEED <br />V� CLERK OF COUNCIL <br />F'T AMENDMENT TO AGREEMENT WITH MANNY HUANTE DBA <br />STAGE PLUS EVENT STAGING SERVICES <br />(SU zNy�\ THIS FIRST AMENDMENT to the above -referenced agreement is entered into on <br />Dec ber 7th , 2021, by and between Manny Huante dba Stage Plus Event Staging Services <br />("Consultant"), and the City of Santa Ana, a charter city and municipal corporation organized and <br />existing under the Constitution and laws of the State of California ("City"). <br />RECITALS <br />A. The parties entered into Agreement No. N-2021-207, dated October 21, 2021, by which <br />Consultant agreed to provide audio equipment, DJ services, and staging services for the City <br />("Agreement"). <br />B. The Agreement remains in effect through December 31, 2021. <br />C. The parties now wish to: expand the scope of work to provide services for the City's Winter <br />Wonderland celebrations; increase the amount to be expended under the Agreement using <br />funds provided under the American Rescue Plan Act ("ARPA") for this project to aid tourism <br />and hospitality in the City's downtown district; and, extend the term of the Agreement. <br />D. ARPA was signed into law in March 2021. ARPA provides funding for a number of different <br />programs, including the Coronavirus State and Local Fiscal Recovery Fund ("SLFRF"), to <br />provide monetary support to local governments to respond to, mitigate, and recover from the <br />COVID-19 public health emergency. <br />E. The scope of services provided by Consultant is an allowable use under the SLFRF because it <br />addresses the negative economic impact of the COVID-19 pandemic on the City's downtown <br />tourism and hospitality sector. <br />The Parties therefore agree: <br />Section 1, Scope of Services, is amended to include the services described in Exhibit I <br />attached to this First Amendment and incorporated herein by reference. <br />2. Section 2.A., Compensation, is amended to increase the not -to -exceed total sum to be <br />expended under the Agreement by $39,700 for the additional services attached hereto in <br />Exhibit 1. The total amount to be expended under this Agreement shall not exceed $47,750. <br />As the recipient of ARPA SLFRF funds, Consultant will be required to comply with any and <br />all compliance requirements for the use of SLFRF funds, any and all reporting requirements <br />for expenditures of SLFRF funds, as well as compliance with 2 CFR 200.332 regarding pass - <br />through entities. <br />3. Section 3, Term, is amended to extend the Term of the Agreement until January 7, 2022. <br />Page 1 of 3 <br />
