riSURANCE ON FILE N-2021-207-01 b� UNTIL INSURANCE EXPIRES WORK MAY PROCEED V� CLERK OF COUNCIL F'T AMENDMENT TO AGREEMENT WITH MANNY HUANTE DBA STAGE PLUS EVENT STAGING SERVICES (SU zNy�\ THIS FIRST AMENDMENT to the above -referenced agreement is entered into on Dec ber 7th , 2021, by and between Manny Huante dba Stage Plus Event Staging Services ("Consultant"), and the City of Santa Ana, a charter city and municipal corporation organized and existing under the Constitution and laws of the State of California ("City"). RECITALS A. The parties entered into Agreement No. N-2021-207, dated October 21, 2021, by which Consultant agreed to provide audio equipment, DJ services, and staging services for the City ("Agreement"). B. The Agreement remains in effect through December 31, 2021. C. The parties now wish to: expand the scope of work to provide services for the City's Winter Wonderland celebrations; increase the amount to be expended under the Agreement using funds provided under the American Rescue Plan Act ("ARPA") for this project to aid tourism and hospitality in the City's downtown district; and, extend the term of the Agreement. D. ARPA was signed into law in March 2021. ARPA provides funding for a number of different programs, including the Coronavirus State and Local Fiscal Recovery Fund ("SLFRF"), to provide monetary support to local governments to respond to, mitigate, and recover from the COVID-19 public health emergency. E. The scope of services provided by Consultant is an allowable use under the SLFRF because it addresses the negative economic impact of the COVID-19 pandemic on the City's downtown tourism and hospitality sector. The Parties therefore agree: Section 1, Scope of Services, is amended to include the services described in Exhibit I attached to this First Amendment and incorporated herein by reference. 2. Section 2.A., Compensation, is amended to increase the not -to -exceed total sum to be expended under the Agreement by $39,700 for the additional services attached hereto in Exhibit 1. The total amount to be expended under this Agreement shall not exceed $47,750. As the recipient of ARPA SLFRF funds, Consultant will be required to comply with any and all compliance requirements for the use of SLFRF funds, any and all reporting requirements for expenditures of SLFRF funds, as well as compliance with 2 CFR 200.332 regarding pass - through entities. 3. Section 3, Term, is amended to extend the Term of the Agreement until January 7, 2022. Page 1 of 3
