On December 21, 2021, after receipt of that letter and with full knowledge of the issues <br />outlined, Councilwoman Thai Phan continued to participate in the HOO amendment matter and <br />quadrupled down on her violation of the code by making a motion to continue the HOO amendment <br />item. <br />The video of the hearing can be found at https://youtu.be/BJM5QCPiOds (Santa Ana Council, Dec 21, <br />2021-English, published by City of Santa Ana). <br />At Hour 4, minute 42, Mayor Sarmiento asks the Council if there are any items they would like to pull <br />from the consent calendar. Councilwoman Thai Phan made the following comment: <br />Thank you Mayor, 1 would like to ask that we again continue Item number 17, that's <br />regarding the Housing Opportunities Ordinance. Last time this item came up 1 asked <br />for a similar continuance in order to receive advice from the FPPC subject to a <br />complaint or referral comment from the public. 1 also did confirm with Madam City <br />Attorney that a request to continue an item is not a violation of FPPC regulations so <br />that is one item. And the other is 1'd like to specifically state that 1 have a conflict of <br />interest on Item 29 only as to the contract for Item 1 which is relating to Atkinson, <br />Adelson, Loya, Ruud, AALR, as they are client of my employer Rutan & Tucker. So 1 <br />will be able to vote on the remaining items on Item 29, but not that particular <br />Agreement. <br />
