DocuSign Envelope ID: DF354F7F-AE9F-4679-9897-A79AD5C7EA50 A- 2 0 2 2 -0 2 4 <br />INSURANCE NOT ON FILE <br />WORK MAY NOT PROCEED THIRD AMENDMENT TO LEASE AGREEMENT WITH <br />CLERK OF COUNCIL ALDRIDGE ELECTRIC, INC. <br />DATE: <br />THIS THIRD AMENDMENT to the above -referenced agreement is entered into on February 15, <br />2022, by and between Aldridge Electric, Inc. ("Tenant") and the City of Santa Ana, a charter city <br />and municipal corporation organized and existing under the Constitution and laws of the State of <br />California ("City"). <br />6n pW8 (0of Lwrwi) ,l)T•T <br />RECITALS <br />A. The parties entered into Agreement No. A-2019-029, dated February 19, 2019 ("Lease <br />Agreement"), by which City leased to Tenant certain office space at the Santa Ana Regional <br />Transportation Center for Tenant's business operations ("Premises"). <br />® B. On June 18, 2019, the parties entered into First Amendment No. A-2019-029-01, by which the <br />�l City amended the Lease Agreement to expand the square footage of the Premises being leased <br />by Tenant and to provide for Tenant's correct entity name. <br />C. On April 7, 2020, the parties entered into Second Amendment No. A- 2019- 029- 02 to expand <br />the square footage of the Premises, extend the Term through February 19, 2022, provide <br />additional extension periods of up to twenty-four (24) months on a month -to -month basis, and <br />increase the monthly rent to Eight Thousand Three Hundred Dollars ($8,300), with any partial <br />month prorated at $273 per day. <br />D. The parties now wish to further amend the Lease Agreement to extend the term of the Lease <br />for two years from February 20, 2022, update insurance requirements and increase the monthly <br />rent. <br />The Parties therefore agree: <br />1. Section 3, Commencement of Term, is amended to extend the Term of the Lease Agreement <br />from February 20, 2022 to February 19, 2024, <br />Section 6, Rent, is amended such that, effective February 20, 2022, the Rent payable under <br />the Lease Agreement shall be the monthly sum of Ten Thousand Three Hundred Sixty -One <br />$10,361 per month, with any partial month prorated at $341 per day. <br />3. Section 17, Insurance, is hereby deleted in its entirety and replaced with the following: <br />Tenant shall procure and maintain for the duration of the contract insurance against <br />claims forinjuries to persons or damages to property which may arise from or in <br />connection with the performance of the work hereunder and the results of that work by <br />the Tenant, his agents, representatives, employees or subcontractors. <br />A.
