For the purposes of this endorsement, the following definitions are added to SECTION V - DEFINITIONS: <br />1. "Defense expenses" means any payment allocated to a specific loss, "claim" or "suit" for its <br />investigation, settlement or defense, including but not limited to: <br />a. attorney's fees and all other investigation, loss adjustment and litigation expenses; <br />b, premiums on bonds to release attachments; <br />c, premiums on appeal bonds required by law to appeal any "claim" or "suit"; <br />d. costs taxed against the "Insured" in any "claim" or "suit"; <br />e. pre -judgment interest awarded against the "Insured"; <br />f. interest that accrues after entry of judgment. <br />2. "Act of terrorism" is defined as: <br />a. A "certified act of terrorism" means any act that is certified by the Secretary of the Treasury of <br />the United States, in concurrence with the Secretary of State, and the Attorney General of the <br />United States to be an act of terrorism pursuant to the federal Terrorism Risk Insurance Act. The <br />criteria contained in the Risk Insurance Act for a "certified act of terrorism" include the following: <br />I. the act resulted in insured losses in excess of $5 million in the aggregate, attributable to all types of <br />insurance subject to the Terrorism Risk Insurance Act; and <br />ii. the act is a violent act or an act that is dangerous to human life, property or infrastructure and is <br />committed by an individual or individuals as part of an effort to coerce the civilian population of the <br />United States or to influence the policy or affect the conduct of the United States Government by <br />coercion. <br />D. Solely as respects any liability arising out of any "act of terrorism," SECTION III. - DEFENSE, Paragraphs A.I. <br />and A.2., are deleted in their entirety, and replaced by the following: <br />A. We will have the right and duty to defend any "claim" or "suit" seeking damages covered by the terms <br />and conditions of this policy when the applicable Act of Terrorism Self -Insured Retention limit has been <br />exhausted by actual payment of "claims" for any "occurrence" to which this policy applies. <br />This endorsement does not change any other provision of the policy. <br />Includes copyrighted material of ISO Properties, Inc., with its permission. <br />GAI 6475 (Ed. 04/10) (Page 2 of 2) <br />
