WHEREAS, SB 1383 requires jurisdictions to adopt and enforce an ordinance or <br />enforceable mechanism to implement relevant provisions of the SB 1383 Regulations. <br />Such an ordinance will also help reduce food insecurity by requiring commercial edible <br />food generators to arrange to have the maximum amount of their edible food, that would <br />otherwise be disposed, be recovered for human consumption; and <br />WHEREAS, this Ordinance implements the requirements of the SB 1383 <br />Regulations by updating Article II (Solid Waste Collection Regulations) of Chapter 16 of <br />the Santa Ana Municipal Code (Garbage, Trash and Weeds); and <br />WHEREAS, to effectively update Article 11 of Chapter 16, it is necessary that Article <br />11 of Chapter 16 be repealed and reenacted in its entirety. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA ANA, <br />CALIORNIA, DOES HEREBY ORDAIN AS FOLLOWS: <br />Section 1. The recitals above are each incorporated by reference and adopted <br />as findings by the City Council. <br />Section 2. Article II (Solid Waste Collection Regulations) of Chapter 16 of the <br />Santa Ana Municipal Code (Garbage, Trash and Weeds) is hereby repealed in its entirety. <br />Section 3. Article II (Solid Waste Collection Regulations) of Chapter 16 of the <br />Santa Ana Municipal Code (Garbage, Trash and Weeds) is hereby reenacted in its <br />entirety to read as follows: <br />ARTICLE 11. — SOLID WASTE COLLECTION REGULATIONS <br />Sec. 16-28. - Short title. <br />This article shall be known and may be cited as the "Municipal Solid Waste <br />Collection Regulations" of the city. <br />Sec. 16-28.5. - Purpose of this article. <br />It is in the public interest, health and safety that the collection, transportation and <br />recycling, diversion by means of composting, mulching, and/or transforming, and disposal <br />of all discarded materials in the city be regulated by the city. In order for the city to both <br />manage the discarded materials generated within the city and to comply with California's <br />regulatory requirements and any amendments made thereto, the city deems it necessary <br />to provide rules and regulations relating to solid waste. <br />Sec. 16-29. - Definitions. <br />Applicant shall mean any individual, firm, limited liability company, association, <br />partnership, political subdivision, government agency, municipality, industry, public or <br />private corporation, or any other entity whatsoever who applies to the city for the <br />Ordinance No. NS-3017 <br />Page 2 of 42 <br />
