RESOLUTION NO. 2022-027 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF SANTA ANA APPROVING THE RELOCATION PLAN <br />FOR THE FAIRVIEW BRIDGE REPLACEMENT AND <br />STREET IMPROVEMENTS (9TH STREET TO 16TH <br />STREET) PROJECT <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS <br />FOLLOWS: <br />Section 1. The City Council of the City of Santa Ana hereby finds, determines, <br />and declares as follows: <br />A. Fairview Street is a major north -south transportation facility, which is <br />designated as a major arterial highway in the City of Santa Ana's Circulation <br />Element of the General Plan. Improving Fairview Street from 9th Street to <br />16th Street has been a long-term priority project to improve safety features <br />at the bridge. <br />B. Effective June 29, 2021, the City Council approved a cooperative <br />agreement between the City and the Orange County Transportation <br />Authority for the Fairview Street Improvements (9th Street to 16th Street). <br />C. The M2 CTFP Master Funding Agreement (No. C-1-2783), as amended, <br />committed OCTA to contribute funding for the Fairview Bridge Replacement <br />and Street Improvements (9th Street to 16th Street) Project. <br />D. The Public Works Agency is acquiring property for sight distance clearance <br />at 9th Street and Fairview Street, and expects to complete the right-of-way <br />acquisition process by summer 2022. Construction is anticipated to begin <br />in spring 2023. <br />E. Pursuant to California Government Code section 7260 et seq., a public <br />entity is required to adopt a relocation plan, by resolution, whenever it enters <br />into an agreement for acquisition of real property or an agreement for the <br />disposition and development of property that would lead to displacement of <br />people from their homes. <br />Section 6002 and 6038 of the California Code of Regulations, Title 25, <br />Chapter 6, et seq., requires the adoption of a Relocation Plan due to the <br />displacement of residential and business occupants. <br />G. A relocation plan has been prepared in conformance with applicable <br />provisions of the California Government Code section 7260 et seq., and the <br />Relocation Guidelines, California Code of Regulations, Title 25, Chapter 6, <br />Resolution No. 2022-027 <br />Page 1 of 3 <br />
