<br />BEFORE THE CITY COUNCIL OF THE
<br />CITY OF SANTA ANA,CA.
<br />The City of Santa Ana encourages the
<br />public to participate in the decision-
<br />making process.The following notice
<br />is being provided so that you can ask
<br />questions,make comments and stay
<br />informed about projects that might be
<br />important to you.We encourage you to
<br />contact us prior to the Public Hearing if
<br />you have any questions.
<br />NOTICE IS HEREBY GIVEN -The City
<br />Council of the City of Santa Ana will hold
<br />a public hearing to receive public
<br />testimony and will take action on the item
<br />described below.
<br />Proposed Action:The City Council is
<br />conducting a public hearing to reintroduce
<br />Zoning Ordinance Amendment No.2021-
<br />03 for a first adoption reading to amend
<br />the Santa Ana Municipal Code repealing
<br />and reenacting in its entirety Article
<br />XVIII.I.of Chapter 41 of the Santa Ana
<br />Municipal Code regarding the Housing
<br />Opportunity Ordinance.The City Council
<br />previously considered and conducted a
<br />first adoption reading of this Ordinance on
<br />November 16,2021.After being
<br />continued from the meetings of December
<br />7,2021,December 21,2021,and
<br />January 18,2022,the Ordinance did not
<br />receive the number of required votes on
<br />the second adoption reading that was
<br />conducted by the City Council on
<br />February 15,2022.
<br />The proposed Amendment will modernize
<br />and update the Ordinance to clarify the
<br />purpose and applicability of the proposed
<br />regulations,to clarify vesting provisions
<br />for development projects,to modify the in-
<br />lieu fee structure,and to incentivize the
<br />use of a skilled and trained local
<br />workforce,as well as other various
<br />sections of the Ordinance to respond to
<br />current development and economic
<br />trends.The Planning Commission vote on
<br />October 25,2021,resulted in a 4-3
<br />recommendation that the City Council
<br />adopt the proposed Amendment with
<br />certain modifications.
<br />Environmental Impact:There is no
<br />environmental impact associated with this
<br />action in that the proposed Ordinance is
<br />not subject to the California
<br />Environmental Quality Act (CEQA)
<br />pursuant to Sections 15060(c)(2)and
<br />15060(c)(3)of the State CEQA Guidelines
<br />because it will not result in a direct or
<br />reasonably foreseeable indirect physical
<br />change in the environment,as there is no
<br />possibility it will have a significant effect
<br />on the environment and it is not a
<br />"project",as defined in Section 15378 of
<br />the CEQA Guidelines.Furthermore,even
<br />if the proposed Ordinance is considered a
<br />project,it falls within the "common sense"
<br />CEQA exemption set forth in CEQA
<br />Guidelines Section 15061(b)(3),excluding
<br />projects where "it can be seen with
<br />certainty that there is no possibility that
<br />the activity in question may have a
<br />significant effect on the environment."
<br />Adoption of this Ordinance will not have a
<br />significant effect on the environment
<br />because the proposed changes will only
<br />modernize,update,and clarify existing
<br />affordable and inclusionary housing
<br />requirements responding to the current
<br />economic and housing trends in the City
<br />and will not cause a physical change in
<br />the environment.Notice of Exemption,
<br />Environmental Review No.2021-107 will
<br />be filed for this project.

<br />be heard on Tuesday,April 5,2022 at
<br />5:45 p.m.or thereafter in the City Council
<br />Chamber,22 Civic Center Plaza,Santa
<br />Ana,California 92702.All interested
