Section 3. The City Council declares that no evidence of new significant <br />impacts or any new information of "substantial importance," as defined by State CEQA <br />Guidelines Section 15088.5, has been received by the City after circulation of the Final <br />Draft Recirculated PEIR that would require recirculation of the PEIR. <br />Section 4. The City Council hereby: <br />A. Certifies the Final Recirculated PEIR based on the entirety of the record of <br />proceedings. <br />B. Adopts the Findings of Fact and Statement of Overriding Considerations, <br />attached hereto and incorporated herein as Exhibit B, after balancing the <br />significant and unavoidable air quality, cultural resources, greenhouse gas <br />emissions, noise, recreation, and population and housing impacts of the <br />proposed project against the benefits of the proposed project. <br />C. Adopts the Mitigation Monitoring and Reporting Program attached hereto and <br />incorporated herein as Exhibit C, consistent with Public Resources Code <br />Section 21081.6; makes implementation of the mitigation measures in the <br />Mitigation Monitoring and Reporting Program a condition of approval of the <br />project; and finds that in the event of any inconsistencies between the <br />mitigation measures set forth herein and the Mitigation Monitoring and <br />Reporting Program, the Mitigation Monitoring and Reporting Program shall <br />control. <br />D. Approves the project, based upon the entire record before it, including the <br />Final Recirculated PEIR, Findings of Fact and Statement of Overriding <br />Considerations, and all written and oral evidence presented. <br />E. Directs City staff to cause a Notice of Determination to be filed and posted <br />with the County of Orange Registrar-Recorder/County Clerk and the State <br />Clearinghouse within five working days of the City Council's final project <br />approval. <br />Section 5. This Resolution shall take effect immediately upon its adoption <br />by the City Council, and the Clerk of the Council shall attest to and certify the vote <br />adopting this Resolution. <br />ADOPTED this 19'h day of April, 2022. <br />Resolution No. 2022-029 <br />Page 6 of 7 <br />
