Fungi Or Bacteria Exclusion Endorsement ZURICH <br />THIS ENDORSEMENT CHANGES THE POLICY. PLEASE READ IT CAREFULLY. <br />Policy No. FLM1084498-00 Effective Date: 06/18/2022 <br />This endorsement modifies insurance provided under the: <br />Commercial General Liability Coverage Part <br />The following exclusion is added to paragraph 2. Exclusions of Section I — Coverage A — Bodily Injury And Property <br />Damage Liability and paragraph 2. Exclusions of Section I — Coverage B — Personal And Advertising Injury <br />Liability: <br />2. Exclusions <br />This insurance does not apply to: <br />Fungi or Bacteria <br />A. "Bodily injury", "property damage" or "personal and advertising injury" caused directly or indirectly by the actual, <br />alleged or threatened inhalation of, ingestion of, contact with, exposure to, existence of, or presence of any: <br />1. "Fungi" or "bacteria"; or <br />2. Substance, vapor or gas produced by or arising out of any "fungi" or "bacteria". <br />B. Loss, costs or expenses arising out of the abating, testing for, monitoring, cleaning up, removing, containing, <br />treating, detoxifying, neutralizing, remediating or disposing of, or in any way responding to, or assessing the <br />effects of, "fungi" or "bacteria", by any insured or by any other person or entity. <br />C. For the purposes of this exclusion, the following definitions are added: <br />1. "Fungi" means any type or form of fungus, including mold or mildew and any mycotoxins, "spores", scents or <br />by-products produced or released by fungi. <br />2. "Spores" means reproductive bodies produced by or arising out of "fungi". <br />3. "Bacteria" means any type or form of bacteria and any materials or substances that are produced or released <br />by bacteria. <br />This exclusion applies to all diseases contracted by contact with "fungi" or "bacteria" in water, water vapor or water <br />droplets, including but not limited to Legionnaire's Disease.
