COMMERCIAL GENERAL LIABILITY <br />CG 24 26 04 13 <br /> <br /> <br />THIS ENDORSEMENT CHANGES THE POLICY. PLEASE READ IT CAREFULLY. <br /> <br />AMENDMENT OF INSURED CONTRACT DEFINITION <br /> <br />This endorsement modifies insurance provided under the following: <br /> <br />COMMERCIAL GENERAL LIABILITY COVERAGE PART <br />PRODUCTS/COMPLETED OPERATIONS LIABILITY COVERAGE PART <br /> <br />The definition of "insured contract" in the Definitions Paragraph f.does not include that part of any <br />section is replaced by the following: contract or agreement: <br />"Insured contract" means: (1) That indemnifies a railroad for "bodily injury" <br />or "property damage" arising out of <br /> a.A contract for a lease of premises. However, <br />construction or demolition operations, within <br />that portion of the contract for a lease of <br />50 feet of any railroad property and <br />premises that indemnifies any person or <br />affecting any railroad bridge or trestle, <br />organization for damage by fire to premises <br />tracks, road-beds, tunnel, underpass or <br />while rented to you or temporarily occupied by <br />crossing; <br />you with permission of the owner is not an <br />"insured contract"; (2) That indemnifies an architect, engineer or <br />surveyor for injury or damage arising out of: <br /> b.A sidetrack agreement; <br /> (a) Preparing, approving, or failing to <br /> c.Any easement or license agreement, except in <br />prepare or approve, maps, shop <br />connection with construction or demolition <br />drawings, opinions, reports, surveys, <br />operations on or within 50 feet of a railroad; <br />field orders, change orders or drawings <br /> d.An obligation, as required by ordinance, to <br />and specifications; or <br />indemnify a municipality, except in connection <br /> (b) Giving directions or instructions, or <br />with work for a municipality; <br />failing to give them, if that is the primary <br /> e.An elevator maintenance agreement; <br />cause of the injury or damage; or <br /> f.That part of any other contract or agreement <br /> (3) Under which the insured, if an architect, <br />pertaining to your business (including an <br />engineer or surveyor, assumes liability for <br />indemnification of a municipality in connection <br />an injury or damage arising out of the <br />with work performed for a municipality) under <br />insured's rendering or failure to render <br />which you assume the tort liability of another <br />professional services, including those listed <br />party to pay for "bodily injury" or "property <br />in (2) above and supervisory, inspection, <br />damage" to a third person or organization, <br />architectural or engineering activities. <br />provided the "bodily injury" or "property <br />damage" is caused, in whole or in part, by you <br />or by those acting on your behalf.
