MSURANC ':J ON FILE <br />WORK V AdPROCEED <br />CLEF, ; of COUNCIL <br />DATE: FIFTH AMENDMENT TO <br />A-2011-258-05 <br />WITH <br />THIS FIFTH AMENDMENT to the above -referenced agreement is entered into on <br />May 2022 by and between International City Management Association <br />Retirement Corporation, now doing business as MissionSquare Retirement ("ICMA-RC"), and <br />the City of Santa Ana, a charter city and municipal corporation organized and existing <br />under the Constitution and laws of the State of California ("City"). <br />0% H2(�,r, S� (S)A) I RECITALS <br />N A. The parties entered into Agreement No. A-2011-258, dated November 28, 2011, that <br />N established a Vantagecare Retirement Health Savings ("RHS") Plan for the Police <br />Management Association and by which Consultant agreed to provide administrative <br />services for the RHS accounts; ("Agreement"). <br />2 <br />B. On March 1, 2012, the Agreement was amended (A-2011-258-01) to add RHS accounts for <br />the City's Fire Management Association and to include administrative services associated <br />with those accounts; <br />C. On October 1, 2014, the Agreement was amended (A-2011-258-02) to add RHS accounts <br />for the City's Santa Ana Management Association and Confidential Association of Santa <br />Ana and to add administrative services for those accounts; <br />D. On May 29, 2015, the Agreement was amended to change the definition of "spouse" to <br />reflect a change in the law; <br />E. On January 1, 2016, the Agreement was amended (A-2011-258-03) to add RHS accounts <br />for the City's part-time and full-time civil service members of SEIIJ and to include <br />administrative services for those accounts; <br />F. On June 30, 2016, the Agreement was amended (A-2011-258-04) to change the RHS Trust <br />plan from Vantagecare to Vantage Trust II Multiple Collective Investment Funds Trust. <br />G. The Parties agree to amend the Agreement to add insurance coverage requirements that <br />ICMA-RC has already been providing. <br />The Parties therefore agree: <br />1. Section 14 regarding insurance requirements is added to the Agreement to read as follows: <br />14. Insurance <br />A.
