This exclusion does not apply to "personal <br />injury" caused by malicious prosecution. <br />b. Material Published With Knowledge Of <br />Falsity <br />"Personal and advertising injury" arising out of <br />oral or written publication, including publication <br />by electronic means, of material, if done by or at <br />the direction of the insured with knowledge of <br />its falsity. <br />c. Material Published Or Used Prior To Policy <br />Period <br />(1) "Personal and advertising injury" arising out <br />of oral or written publication, including <br />publication by electronic means, of material <br />whose first publication took place before <br />the beginning of the policy period; or <br />(2) "Advertising injury" arising out of <br />infringement of copyright, "title" or "slogan" <br />in your "advertisement" whose first <br />infringement in your "advertisement" was <br />committed before the beginning of the <br />policy period. <br />d. Criminal Acts <br />"Personal and advertising injury' arising out of a <br />criminal act committed by or at the direction of <br />the insured. <br />e. Contractual Liability <br />"Personal and advertising injury" for which the <br />insured has assumed liability in a contract or <br />agreement. This exclusion does not apply to <br />liability for damages: <br />(1) That the insured would have in the absence <br />of the contract or agreement; or <br />(2) Because of "personal injury" assumed by <br />you in a contract or agreement that is an <br />"insured contract", provided that the <br />"personal injury' is caused by an offense <br />committed subsequent to the execution of <br />the contract or agreement. Solely for the <br />purposes of liability assumed by you in an <br />"insured contract", reasonable attorneys' <br />fees and necessary litigation expenses <br />incurred by or for a party other than an <br />insured will be deemed to be damages <br />because of "personal injury", provided that: <br />(a) Liability to such party for, or for the <br />cost of, that party's defense has also <br />been assumed by you in the same <br />"insured contract": and <br />(b) Such attorneys' fees and litigation <br />expenses are for defense of that party <br />COMMERCIAL GENERAL LIABILITY <br />against a civil or alternative dispute <br />resolution proceeding in which <br />damages to which this insurance <br />applies are alleged. <br />f. Breach Of Contract <br />"Advertising injury" arising out of a breach of <br />contract. <br />g. Quality Or Performance Of Goods - Failure <br />To Conform To Statements <br />"Advertising injury" arising out of the failure of <br />goods, products or services to conform with <br />any statement of quality or performance made <br />in your "advertisement". <br />h. Wrong Description Of Prices <br />"Advertising injury" arising out of the wrong <br />description of the price of goods, products or <br />services stated in your "advertisement". <br />1. Intellectual Property <br />"Personal and advertising injury" arising out of <br />any actual or alleged infringement or violation of <br />any of the following rights or laws, or any other <br />"personal and advertising injury" alleged in any <br />claim or "suit" that also alleges any such <br />infringement or violation: <br />(1) Copyright; <br />(2) Patent; <br />(3) Trade dress: <br />(4) Trade name: <br />(5) Trademark: <br />(6) Trade secret; or <br />(7) Other intellectual property rights or laws. <br />This exclusion does not apply to: <br />(1) "Advertising injury" arising out of any actual <br />or alleged infringement or violation of <br />anothers copyright.
