INSURANCE NOT REQUIRED <br />N-2022-209 <br />WORK MAY PROCEED <br />CLERK OF THE COUNCIL <br />D(VE: CONSULTANTAGREEMENT <br />o CITY OF SANTA ANA <br />o THIS AGREEMENT is made and entered into on this 30th day of June, 2022 by and between <br />CD <br />L Dustin Lam, ("Consultant'), and the City of Santa Ana, a charter city and municipal corporation <br />organized and existing under the Constitution and laws of the State of California (`City"). <br />4C <br />0 • 6ACS(ogN6a RECITALS <br />J <br />A. The City desires to retain a Consultant having special skill and knowledge in the field of <br />photography, media development, and community engagement. <br />B. Consultant represents that Consultant is able and willing to provide such services to the <br />City. <br />C. In undertaking the performance of this Agreement, Consultant represents that it is <br />knowledgeable in its field and that any services performed by Consultant under this <br />Agreement will be performed in compliance with such standards as may reasonably be <br />expected from a professional consulting firm in the field. <br />NOW THEREFORE, in consideration of the mutual and respective promises, and subject to the <br />terms and conditions hereinafter set forth, the parties agree as follows: <br />1. SCOPE OF SERVICES <br />a. Consultant shall perform during the term of this Agreement, the tasks and obligations <br />including all labor, materials, tools, equipment, and incidental customary work required <br />to fully and adequately provide media support services for Councilmember Thai Viet <br />Phan (`Councilmember") as provided in this Agreement and in the Scope of Services, <br />Exhibit A, attached hereto and incorporated by reference. <br />b. At the direction of Councilmember, Consultant shall provide on -call media services as <br />requested, such as photography, videography, and editing. <br />c. As may be required for services at City Hall, the City may provide temporary office <br />space, and facility access — consistent with City procedures — should Consultant require <br />limited access to perform services required by the Councilmember. Consultant shall <br />maintain a business location separate from City and Consultant understands that such <br />temporary office space and/or facility access is not required by the City but provided <br />to the Consultant on an as -needed basis <br />2. COMPENSATION <br />a. City agrees to pay, and Consultant agrees to accept as total payment for its services for <br />City, the rates and charges identified in Compensation - Exhibit B. The total amount <br />to be expended during the terns of this Agreement shall not exceed $15,000. <br />
