Contractor shall be in compliance with the Prevailing Wages and requirements effective <br />the due date of this proposal submittal and shall pay prevailing rates of per diem wages <br />according to state law at all times throughout the term of any future agreement with the <br />City. Contact shall make copies of the prevailing rates of per diem wages for each craft, <br />classification or type of worker needed to execute the Services available to interested <br />parties upon request, and shall post copies at the Contractor's principal place of business <br />and at the job site. Contractor shall defend, indemnify and hold the City, its elected <br />officials, officers, employees and agents free and harmless from any claim or liability <br />arising out of any failure or alleged failure to comply with the Prevailing Wage Laws. <br />1. COMMUNITY WORKFORCE AGREEMENT <br />On August 15, 2017, the Santa Ana City Council approved a Community Workforce <br />Agreement with the Los Angeles/Orange Counties Building and Construction Trade <br />Council and the Signatory Craft Councils and Unions. The provisions of the agreement <br />would apply to all construction and major rehabilitation work pursuant to "Prime Multi - <br />Trade" construction contracts that exceed $250,000 and all subcontracts from these prime <br />multi -trade contracts. The agreement also applies to all "Prime Specialty" contracts (single <br />trade contracts) that exceed $100,000 and all subcontracts from these prime specialty <br />contracts. Contractors working on task orders over the above thresholds must, in filling <br />craft job requirements, utilize and be bound by the registration facilities and referral <br />systems established and authorized by the Unions who are signatory to the agreement. This <br />is commonly referred to a Union hiring hall. Contractors retain the right to reject any <br />applicant referred to them through the job referral system, determine competency of all <br />employees, to determine the number of employees required, and the duties of such <br />employees. If any Union's registration and referral system does not fulfill the requirements <br />for specific classifications requested by any Contractor within 48 hours, the Contractor <br />may employ applicants meeting such classifications from any other available source. <br />J. SAFETY PROGRAM REQUIREMENTS <br />The Proposer shall be solely responsible for ensuring that all work performed under the <br />contract is performed in strict compliance with all applicable Federal, State and local <br />occupational safety regulations. The Contractor shall provide at its expense all safeguards, <br />safety devices and protective equipment, and shall take any and all actions appropriate to <br />providing a safe Construction site. <br />The following is also required in addition to being in compliance with the above and related <br />latest editions (unless noted otherwise) of the standard specifications and/or plans in the <br />APWA "Greenbook (2018 Edition)" CA MUTCD, AGC, SSPWC, TEES, CALTRANS <br />Standard Plans and Standard Specifications, CALTRANS Highway Design and Traffic <br />Manuals, as listed below and as related to the standard care of the industry: <br />SOMEONE <br />City of Santa Ana RFP 22-031 <br />Page 9 <br />
