VI. AWARD OF AGREEMENT <br />A. REQUEST FOR COUNCIL ACTION <br />Following evaluation and rating by the proposal review committee, the Executive Director <br />of Public Works will recommend award of an agreement to the proposer providing the best <br />quality and value to the City. <br />B. EXECUTION OF AGREEMENT <br />A standard agreement is included as Attachment 2: Standard Agreement in the Appendix <br />of this RFP. "Proposer" will hereinafter be referred to as "Contractor" in standard <br />agreement. The term of the agreement will begin after the agreement is fully executed, and <br />all required insurance and documents and contents of the vendor registration and payment <br />information packet have been received and approved. <br />VIL IMPLEMENTATION <br />NOTICE TO PROCEED <br />Prior to issuance of a formal Notice to Proceed (NTP), Consultants shall provide all <br />required bonds, insurance documents, and contents of the Information Packet for review <br />and approval by the City. <br />For "On -Call' contracts, individual City Project Managers will request project/task <br />specific proposals from Consultants on an as -needed basis. Proposals will then be <br />evaluated by City staff and written NTPs will be issued accordingly per each task order. <br />VIH. PUBLIC RECORDS <br />All data, documents and other products used, developed, or produced during response <br />preparation of this RFP will become property of the City. All responses to this RFP shall <br />become property of the City. Proposer information identified as proprietary information <br />be maintained confidential, to the extent allowed under the California Public <br />Records Act. <br />Proposals will become public record after award of contract.
