In offering such programs, the church is also <br />creating spaces of gathering, which supports Policy LU – 2.3. <br />Additional Legal Consideration <br />Federal law prohibits the imposition of a local land use regulations that imposes a <br />substantial burden on the religious exercise of a person or religious assembly or <br />institution. This law is known as the Religious Land Use and Institutionalized Persons Act <br />(RLUIPA). So long as a municipality applies its codes unfirmly and does not impose an <br />unjustified substantial burden on religious exercise, it may apply traditional zoning <br />concerns – such as regulations addressing traffic, hours of use, parking, maximum <br />capacity, intensity of use, and development standards – to religious uses just as they to <br />any other land uses. Accordingly, these concerns have been addressed in the conditions <br />of approval that are attached to the CUP. <br />Public Notification and Community Outreach <br />Public notifications were posted, published, and mailed in accordance with City and State <br />regulations. Copies of the public notice, including a 1,000-foot notification radius map, <br />and the site posting are provided in Exhibit 7. There are no established Neighborhood <br />Associations in the vicinity as the property is surrounded by industrial and commercial <br />uses within the 1,000-foot radius. At the time this report was printed, no issues of concern <br />were raised regarding the proposed CUP. <br />ENVIRONMENTAL IMPACT <br />Pursuant to the California Environmental Quality Act (CEQA) and the CEQA Guidelines, <br />the project is exempt from further review pursuant to Sections 15301 and 15303 of the <br />CEQA Guidelines Class 1 - Existing Facilities). The Class 1 exemption applies to the <br />permitting, leasing, licensing, or minor alteration of existing private structures involving <br />negligible or no expansion of existing or former use. Based on this analysis, a Notice of <br />Exemption, Environmental Review No. 2022-61 will be filed for this project. <br />FISCAL IMPACT <br />There is no fiscal impact associated with this action. <br />EXHIBIT(S) <br />1.
