Resolution No. 2022-26
gross floor area for display and storage of alcoholic
beverages, which is the maximum threshold established by
the SAMC. In addition, operational standards will ensure the
project remains in compliance with all applicable codes and
regulations related to alcohol sales to ensure that the use
does not impact neighboring properties or create an attractive
nuisance.
5. That the proposed use will not adversely affect the General Plan of
the city or any specific plan applicable to the area of the proposed
use.

The proposed sale of alcoholic beverages for on premise
consumption at this location will not adversely affect the
General Plan or any specific plan. The granting of this CUP
supports several goals and policies contained in the General
Plan. Policy 1.1 of the General Plan Land Use Element
encourages development that fosters compatibility between
land uses to enhance livability. The eating establishment
would be located within a suite previously occupied by similar
land uses where request for the ABC License would not alter
the nature of the business but rather afford them the
opportunity to offer a full-service dining experience. It is not
anticipated to introduce new impacts and thus remain
consistent with the surrounding environment. Policy 2.6 of the
Land Use Element promotes rehabilitation of properties and
encourages increased levels of capital investment to create a
safe and attractive environment. In line with this policy, the
applicant is proposing to make onsite improvements to include
new finishes, furnishings, and replacing the existing patio
enclosure with a glass and wrought iron railing that would
open up the space. Furthermore, Policy 2.7 of the Land Use
Element supports land use decisions that encourage the
creation, development, and retention of business in Santa
Ana. Allowing the business the ability to serve beer and wine
will allow Roquette Café & Bistro to enhance business
offerings and compete with nearby full-service restaurants
that offer similar services and thus support the creation of the
new business. Moreover, Policy 4.1 of the Land Use Element
supports developments that promote complete
neighborhoods by encouraging a mix of complementary uses,
community services, and people place within a walkable area.
Approval of this CUP would promote the success of the eating
establishment that would offer various goods within a
walkable distance for employees or neighboring residents.

Section 2. In accordance with the California Environmental Quality Act (CEQA)
and the CEQA Guidelines, the project is categorically exempt from further review per
Section 15301 (Class 1 – Existing Facilities). Class 1 exemption applies to the operation,
