Carvalho <br />CLERK OF THE COUNCIL <br />The City of Santa Ana ("City") entered into Agreement No. A-2019-103, dated July 2, 2019, which has <br />been amended six times since that date (`Agreement"), with Landscape West Management Services, Inc. <br />("Contractor") for right-of-way and median landscape maintenance services ("Services"). Pursuant to <br />section 2, Compensation, of said Agreement, the City shall provide funding to Contractor for the Services. <br />Please be advised that going forward, the City will be using funds made available to it by the American <br />Rescue Plan Act of 2021 ("ARPA") to pay all or a portion of this compensation, and that Contractor will <br />be responsible for abiding by the rules and regulations associated with said funding. <br />ARPA was signed into law in March 2021. ARPA authorizes the United States Department of Treasury <br />("Treasury") to provide funding for a number of different programs, including the Coronavirus State Fiscal <br />Recovery Fund and the Coronavirus Local Fiscal Recovery Fund, together known as the Coronavims State <br />and Local Fiscal Recovery Funds ("CSLFRF"), to provide monetary support to local governments to <br />respond to, mitigate, and recover from the COVID-19 public health emergency. The City has determined <br />that this Agreement is a permissible use of CSLFRF funds. <br />As applicable, Contractor shall comply with all federal requirements including, but not limited to, the <br />following: <br />a. Sections 602 and 603 of the Social Security Act as added by Section 9901 of ARPA; <br />b.
